I think this is the same Court that was overturned in Heller vs DC. They don't read the Constitution.

The mindset is that of disregard for the Constitution.
They know what’s in it, they just put its authority way down the list from their own “intellect” and ability to make ad hoc decisions to shape society.

“The right to be free from federal regulation is not absolute and yields to the imperative that Congress be free to forge national solutions to national problems,” Judge Laurence Silberman, an appointee of President Ronald Reagan, wrote in the 2-1 opinion. Silberman was joined by Judge Harry Edwards, a Carter appointee.

This does not bode well for us.

If the US Gov’t can mandate we buy Medical Insurance; they then can mandate we buy only GM cars/trucks, purchase certain Foods, consumer electronics - why, the USA will become the beacon of Eutopia that the USSR currently enjoys. Just ask any Russian immigrant how great that will be. < /s>

I can think of no better evidence to disbar a judge, this is pretty much a Constitutional litmus test - and the judge failed. Perhaps there is a career for him at McDonalds.

I watching the Holder Hearing....this question was brought up.. Holder said that in conversations over the constitutionally of ObamaCare, Kagan was asked to leave the room.
Not one Repub asked why she would be asked to leave when she wasn't even considered for the USSC..
They just set it up for Kagan to sit in ...

Never mind that “health insurance” was not an enumerated power. Just like “education” was not an enumerated power, and the “environment” is not an enumerated power...........and the beat goes on...

WASHINGTON — A conservative-leaning panel of federal appellate judges is upholding President Barack Obama’s health care law as constitutional, helping set up a Supreme Court fight.

The U.S. Court of Appeals for the District of Columbia issued a split opinion Tuesday upholding the law. The court agreed to dismiss a Christian legal group’s lawsuit claiming the requirement that all Americans get health insurance is unconstitutional and violates religious freedom.
