Court order allows Occupy Wall St. protesters back

The National Lawyers Guild says it has obtained a court that allows Occupy Wall St. protesters to return with tents to a New York City park.

The guild says the injunction prevents the city from enforcing park rules on Occupy Wall Street protesters.

Mayor Michael Bloomberg says the city knew about the court order but has not seen it. He says the city plans to go court immediately.

One of the core problems here is the nature of this property. It is privately owned, but the owner is required by agreement with the city to maintain public access to the park around the clock, so the owner does not really exersize full control of the site. I gather that the park was provided by the property owner in exchange for zoning variances on a nearby building.

Since nobody has control of the park, situations like this can fester. I private owner with full authority can have trespassers thrown off immediately. If it were a NYC public park, it would be closed overnight. But this property is neither fish nor foul, so it is difficult to control the situation.

Frankly, the city should just amend the agreement to make the park function like the NYC parks, and have it close down every day from midnight to 5AM. Then it could be cleaned daily and the only mess these idiots could create would be the mess they can create each day.

Bloomberg backs these slugs 100% and this gives him cover for doing nothing. He can now say to all the folks who are being deprived of their own rights by these sleazes that he has dome all he could but the courts have over ruled him.

If he were a stand up guy he would rise up to his full 4 ft 9 inches and tell the Judge to pound salt.

Ha! I was in such a hurry to get it posted, I didn't notice. The error was in the original article, but the URL has now been updated with a more extensive article.

And the correction has been made to that paragraph.

I think the major problem here was the overnight clean up...

After getting the OWS out of the park the city should have just left it as it was for a few days with armed guards at night...

Just let them into their own mess during the day

What are they going to do now ???

Daily maid service paid for by the city and ultimately the law abiding taxpayers ???

Wow, so much for property rights. This park is PRIVATE property. This is outrageous, these occupoopers are getting away with so much it’s beyond funny now.

Well, if they had a real mayor the reply to the judge and the court order should have been “Nice court order Judge, now try to enforce it”. She can’t order in the national guard, she has no enforcement body under her control.

My friend you obviously are not a land owner. All we have the right to do, concerning our own property is, pay taxes on it.

Do you know that if I post every inch of my property, yet a kid trespasses, climbs on a piece of heavy equipment, breaks into it, and get's hurt, I am going to get sued? Now, the kid my get probation for trespassing and for the damage done, but I am going to end up paying at a minimum, his medical bills.

Trust me on this, property owners rights are a thing of the past in the land of the free, the home of the brave.

I guess bums and the homeless can set up camp in any public space they desire as long as they protest something.

Do you think I could take a copy of this order and park my RV in front of the courthouse? Could I dump my holding tanks there too?
