The National Labor Relations Board, the subject of particularly intense partisan sniping this year, could soon be completely paralyzed.
The labor board's sole Republican member, Brian E. Hayes, has threatened to resign to deny the N.L.R.B. the three-person quorum it needs to make any decisions, according to board officials. Mr. Hayes has made his threat expressly to block the Democratic-dominated board from adopting new rules to speed up unionization elections, which the board's other current members, both Democrats, intend to pass Nov. 30.

What is the down side to him quitting? I assume an appointee by Hussein would have to be approved by the Senate, and I am assuming the Senate has enough Republicans to block Hussein.

my only question is why hasn’t this happened until now?!

I assume an appointee by Hussein would have to be approved by the SenateUnless he made another recess appointment like he did with the last appointee. Nonetheless, I like this guy's thinking. I hope he does it.

The GOP House has vowed to not go into recess again to prevent Obama from making recess appointments. Occasionally they can play hardball.

I will believe the Republicans can play hardball when I see it.
I like this mans courage though, although I am sure the Democrats will find a way to get their Union friends what they want.

Under the rules, Obama would have to appoint a Republican, that is, if he follows them.

Well he has a Nov. 30th deadline - not much time. Even so I’d have a strategy meet with House and/or Senate GOP leaders to at least coordinate and see if they’ll block recess appointments.

I am assuming the Senate has enough Republicans to block Hussein.
Just like Scott Brown was the "supposed spoiler" to Obamacare, Harry Reid will find some obscure rule - or better yet change the Senate rules - so as to skirt that requirement. Reid has talked about changing the filibuster rule for sometime now.

It looks like the House can stop the Senate from going into recess thus stopping recess appointments by the president.
Excerpt:
"This morning - under the instruction of Speaker Boehner, Leader Cantor, and Whip McCarthy - I presided over a pro forma session in the United States House of Representatives, preventing Congress from going into recess and blocking President Obama from issuing recess appointments. * * * Under Article 1, Section 5 of the Constitution, the House of Representatives can prevent the Senate from recessing by withholding its consent. Simply put: we do so by voting down, or not considering, a Senate adjournment resolution. And when we do so, we block the Administration's ability to make recess appointments."
