Montanans Launch Recall of Senators Who Approved NDAA Military Detention. Merry Christmas, US Senate

(HELENA) - Moving quickly on Christmas Day after the US Senate voted 86 - 14 to pass the National Defense Authorization Act of 2011 (NDAA) which allows for the indefinite military detention of American citizens without charge or trial, Montanans have announced the launch of recall campaigns against Senators Max Baucus and Jonathan Tester, who voted for the bill.

Term limits for federal officials were rejected by the federal court. Can’t see this as being any different.

That is so true. We don’t have the organizations in place like the left put together decades ago.....all the homosexual groups, feminist groups, unions, ACORN groups, Soros groups, plus all of MSM is hard to counter.

We need to get organized and work together like the above groups. There are more of us—but they are well organized and control the indoctrination in the schools-—(minds of the children). We need to get local control of schools and burn the Bill Ayers textbooks filled with BF Skinner “one way to think” agitprop.

Both are democrats. I don’t know why MT votes for Dems and then is shocked, shocked I say, when the Dems vote to violate the Bill of Rights. Dem, GOP, or Independent, every US Senator who supported this should be recalled.

The United States Constitution expressly establishes the exclusive qualifications for congressional office, sets the specific length of terms for Members of the House and for Senators, and places the authority within each House of Congress to judge the elections and qualifications of, and to discipline and remove, its own Members. These provisions of the United States Constitution, with respect to federal officials, have supremacy over State laws and provisions, and State laws in conflict with such constitutional provisions have been found by the courts in the past to be invalid. Although the language of some State recall laws might be broad enough to include Members of Congress, or might even explicitly include such federal officers, such statutes would not appear to be effective in overriding the provisions of the United States Constitution with regard to terms of office, elections and removal of Members.

The United States Constitution does not provide for nor authorize the recall of United States officers such as Senators, Representatives, or the President or Vice President, and thus no Member of Congress has ever been recalled in the history of the United States.

Since the vote was 86-14, it seems like plenty of Republicans joined with the Democrats.

Not sure about the nine, but here in Wisconsin, the Dems have been convulsing since losing the governor, assembly and senate two years ago. Ever since, they've been trying to recall anything that moves. Never mind it's petty and obnoxious, it has cost our state multiple millions to hold recalls.

despite the fact you don't like your senators, I hope your state actually has difficult recall rules or some day you might end up with the comstant state of recall we are currently experiencing.

Shouldn't matter what the constitution says now. Congress, as well as the president upon his signing, just nullified it and the bill of rights. Some might say it's ” game on” for the people to do as they wish. Congress might should consider rule of law is a two way street.

I just e-mailed Mark Levin on this. Mark has been a strong supporter of that Dinosaur RINO Orrin Hatch of Utah (my home State).

Mark had better call him out on his vote on this. If Mark continues to support him, I'm sooooo done listening to Levin! I feel fairly good that Levin will say something about this, and indeed condemn it.

Doesn’t matter what the states say, the recall for a Congresscritter is subject to Federal law and there is no provision for a Federal recall. CRS (Congressional Research Service) had a white paper up on that for a while.

The bigger question is, why was the NDAA Military Detention Bill introduced in the first place? What do our “dear leaders” think is coming down the pike??
