Federal Court Upholds Obama/Holder Gun Registration Scheme; Congressional Action Needed

Moments before this alert was to go out, a federal district court in Washington, D.C. issued a ruling upholding an Obama administration policy that requires federally licensed firearms retailers in states bordering Mexico to report multiple sales of semi-automatic rifles.  The case was brought by two NRA-backed firearms retailers and by the National Shooting Sports Foundation acting on behalf of its affected members.  Plaintiffs plan to appeal immediately—but in the meantime, your help is urgently needed in seeking congressional action to end this illegal policy.

Devised by Attorney General  Eric Holder’s Bureau of Alcohol, Tobacco, Firearms and Explosives, the plan requires all of the 8,700 firearm dealers in California, Arizona, New Mexico and Texas to report all sales of two or more semi-automatic rifles within five consecutive business days, if the rifles are larger than .22 caliber and use detachable magazines.  (The plaintiffs in the case pointed out that this was about 20 times more dealers than had been subject to any similar “demand letter” before, but in today's decision the court nonetheless found the new requirement “limited in scope.”)

In July, the Justice Department announced that it would proceed with the controversial reporting procedure.  During consideration of the FY 2012 Commerce, Justice, Science Appropriations bill, pro-gun U.S. Rep. Denny Rehberg (R-Mont.) offered an amendment in committee to prohibit the use of funds for the unauthorized reporting plan and the amendment was passed by a vote of 25-16.  Unfortunately, the Rehberg amendment did not make it through the appropriations process.

Much has transpired since then regarding BATFEs’ failed “Operation Fast and Furious,” and evidence is now clear that “Fast and Furious” was used as justification to force the multiple sales reporting requirement.

In early December, CBS News reported that BATFE “discussed using their covert operation “Fast and Furious” to argue for controversial new rules about gun sales.”  In particular, agency officials wanted guns to fall into Mexican drug cartel hands and be traced back to gun dealers in the U.S. to make a case for requiring the multiple sales reporting.

According to CBS, “Emails show they discussed using the sales, including sales encouraged by ATF, to justify a new gun regulation called Demand Letter 3.  That would require some U.S. gun shops to report the sale of multiple rifles or ‘long guns.’”

CBS singled out a July 14, 2010 email sent by BATFE Field Operations Assistant Director Mark Chait to Bill Newell, the agency’s Special Agent in Charge in Phoenix, where “Fast and Furious” was based.  In the email, Chait asked Newell to “see if these guns were all purchased from the same [licensed gun dealer] and at one time.  We are looking at anecdotal cases to support a demand letter on long gun multiple sales.”

Last March, U.S. Sens. Jon Tester (D-Mont.) and Richard Burr (R-N.C.) introduced S. 570 -- "a bill to prohibit the Department of Justice from tracking and cataloguing the purchases of multiple rifles and shotguns."  The bill would prohibit the use of federal money needed to fund the multiple sales reporting requirement.

Just like with the pedophiles, they have friendly judges in their corner every time, and so it is with Eric Holder and his "Fast and Furious" scammers.

We need to bring this judge in to discuss things with the appropriate House committee.

Wow! What a surprise - my two senators, Patty Murray and Maria Cantwell, are NOT on the list of co-sponsors! From the way that they scream about the “Right to Privacy” at every opportunity you'd think they would be all in favor of a bill that limits the Federal Government trying to restrict citizens who are simply exercising their Constitutional Rights!

Oh. wait, this is about gun rights, which are actually in the Constitution...as opposed to the right to kill children right up until the moment they exit the birth canal, which is evidently enshrined in the unwritten, angry feminist version of the Constitution that the rest of us aren't allowed to see!

Already got my scary semi-automatic long rifles that are larger than 22s. Now I’m buying extra magazines that hold 20 and 30 rounds and buying bulk ammo for all my scary assault rifles and pistols. Better get out there and buy before the cutoff comes. Thinking about the reporting requirements ... probably most of the buyers reported will be ATF and Justice Dept. personnel running guns for the Food Stamp President’s re-election campaign fund.

There will be a housecleaning either between now and the election or certainly one after the election. But what we are going to continue doing, we are deposing witnesses in the days to come, finishing our evidence trail and we are going to send the package up and expect the president to respond to what is a clear process of mostly political appointees knowingly let this happen. And one thing that came out very clear today, Sean, is that there is a Rahm Emanuel moment that is pretty obvious, that when this disaster was happening, they decided to be opportunist and use it to expand the gun database that they are now executing by their won regulations in four states and asking Congress to expand nationally. Very clearly, they made a crisis and they are using this crisis to somehow take away or limit people's second amendment rights.

Anyone else catch that?

Once they’ve done that they just expand the requirements slightly and Hello! Gun Registration.

No surprise that McCain isn't on the list, I did expect Kyl to be on it, he gets more usless every day.

They might prefer jail to one of many possible alternatives. People are getting real tired of this stuff. It’s going to pop hard at some point.

I agree congressional action is needed— But I am more and More convinced that this nation divided against itself and turned from being a nation under God must go under for there to be anything redeemed.Our system— Congress is as broken as the Executive— and God only knows what we ought do with the despotic weakest branch-the Judiciary.If I were to attempt rewrite Scripture for today’s America I would say “In those days there was no Law in America and everyone did what was right in their own eyes.As we have been educated to believe.

The Food Stamp Kenyan and the rest of the Chicago Stalinists are trying to disarm our Society one “gun law” at a time. Everyone needs to get what they want now, because if these criminals get another 4 years, then I suspect 2nd Amendment believing Americans are on the way to being branded as criminals by this “government.”. What happens after we are all branded as such will certainly be cataclysmic.
