He wasn’t going to win GA anyway,
but,

this does go a long way when people start asking questions like

“why don’t you just prove that you are eligible and get it over with?”

GA SOS Brian Kemp was just on the Rusy Humphries show a few moments ago. He says the next step is that the judge will render a initial decision in the case and then send it and supporting documentation over to Kemp for review. Then Brian Kemp will make a final decision based on the judge’s initial decision and the other supporting docs. That is how it will go down. As far as I know if the SOS says Barry does not meet the eligibility requirements then he is off the ballot.

The judge’s decision was chiefly requested on the question of whether or not Obama is a Natural Born Citizen.

But a lot of the other very embarrassing facts were also entered into evidence. It could be argued that they are not relevant, but if Obama were to appeal this decision, he would have kind of a wasp’s nest here to deal with—including the questions of possible Kenyan birth or Indonesian adoption, a faked COLB posted at the White House web site, the suspicious social security number, the out-of sequence number on the supposed COLB, and much else.

Presumably if his lawyer shows up in a higher court to appeal, he can be questioned about all these matters, now entered into evidence, unless he gets a very liberal judge who tells the other lawyers to just shut up.

It does matter. IMHO if he doesn’t care enough to make sure he is on the ballot it gives voters everywhere doubt as to whether or not he is hiding something. This could have have easily been laid to rest with a birth certificate taken to court by his attorney, but his attorney did not even show up to give any kind of an argument.

In any case, this will not help him at all.

I believe, with a favorable ruling, that the GA SOS wouldn’t even be able to certify Obama electors, should he win GA by a write-in vote.

It also sets a precident for other states.

He can have his name written on 100% of the ballots, if he’s ineligible the ballots are tossed.

IF (a BIG IF) this winds up getting legs, look for it to get to the USSC post-haste given that this is an election year and this matter must be timely resolved.

The two questions then become:
1. Will Kagan and Sotomayor recuse themselves because of direct conflict of interst; and

2. Will the Supreme’s over-turn their prior ruling on natural born-citizen and merely require that a single parent be born in the United States?

if he’s not eligible to be on the ballot, write in votes are null and void - no obama votes no matter what if he’s ineligible. :)

The supreme court has no authority to overturn the Constitution.

And judges can be impeached.

I thought I read that decisions by this type of court are not appealable.

However, if this isn't the case, my guess is that the Obama team didn't show today....and they won't show for a decision next time......hoping for a 'Rat judge to make a favorable decision on appeal.

They had little hope with this particular judge who appears to have a spine.

The Constitution does not define “Natural Born Citizen” which is why the USSC had to develop a definition in the 19th century case. The USSC is certainly within their rights to over-turn their own decisions.

Interesting thing about write-ins: different spellings of the same name get entered into the logs as if they are different people. So he could get enough write-ins to win, but not really if 10% or so were misspelled. Likewise with initials. So, cumulatively, B.H. Obama, Barack Hussein Obama, Barack Obama, Barach Obama, etc., could get enough votes, but each would be counted as a different candidate. At least, that is the way it works in my state.

If there IS a problem (like there isn’t a suitable BC) then showing up wouldn’t help him in any way. Sometimes ignoring a problem is the best hope for making it go away.

2010 US Census shows Georgia is 30.5% black and 8.8% hispanic. He will likely capture 90% of these demographics in an election or 35% of the total. He needs only 16% more (made up of whites, Asians, and American Indians) to win the state in 2012. McCain did win the state in 2008.
