Johanns to Cordray: ‘I Can’t Imagine How Anyone Can Maintain Your Service Is Valid’

(CNSNews.com) - Richard Cordray did not face a threatened boycott by Republican senators during his appearance Tuesday before the Senate Banking, Housing and Urban Affairs Committee, but Sen. Mike Johanns (R-Neb.) told Cordray that President Obama had unconstitutionally appointed him as director of the Consumer Finance Protection Bureau.

Johanns said he did not intend to “revisit” and “stir up” the controversy surrounding Cordray’s possibly unconstitutional recess appointment, “because I think that’s going to happen. I think there’s going to be litigation that will make that happen.”

But Johanns politely but firmly told Cordray he did not accept the validity of the appointment.

Cordray sounds pathetically thuggish. First thing that happens once a judge rules that he wasn't lawfully appointed is he gets sent the bills for everything he's authorized to be spent.

Should be fun.

Isn't this the guy that was up the chain of command as boss to that ignant woman who released "Joe The Plumber's" personal information.

Too bad, every legislator (both parties) who retains even a hint of respect for our constitution should have walked out.

At the least they should have turned their backs and ignored him until he left.

We have too many wimps in office.

Seems to me Obama can always say “well, if he’s not truly the nominal head of this agency, then I am, and Cordray is just an unconfirmed czar facilitating it.”

The law specifically stated that the agency itself cannot even come into existence without a head APPROVED by the US Senate—add to this the senate was not in recess when Obama made him a “recess” appointment and your house cat has as much authority.
