Grocery store shooter not charged, speaks about incident(WI)

The Aldi customer who shot an armed robber in the store Monday won't face any criminal charges, prosecutors confirmed Friday.

Milwaukee County District Attorney John Chisholm said the law allows use of reasonable force in threatening situations, regardless of whether the shooter has a concealed weapons permit.

"He disrupted an act that potentially exposed himself and others to great bodily harm," Chisholm said. Video footage from the store showed "he acted reasonably and in a controlled manner during the encounter," Chisholm said.

The customer, Nazir Al-Mujaahid of Milwaukee, held a news conference to discuss the incident. Al-Mujaahid, 35, called it nothing to brag about, but that "sometimes you have to do what you have to do."

Al-Mujaahid said he and his wife stopped at the store, at N. 76th St. and W. Villard Ave., for some last-minute dinner items. They'd never shopped at the store before, he said.

He said they had just walked in when he noticed the suspect approach the cashiers holding up a shotgun with the stock cut off and a bag, demanding money in a very agitated way. Fearing for the safety of himself, his wife and others in the store, he said, he unholstered his semi-automatic 9mm handgun, cocked it and kept it down at his side as he motioned another customer behind the robber to move away.

When the robber turned the shotgun toward him, Al-Mujaahid said, he fired six or seven shots from about 20 feet away. He said he hit the suspect in the leg and forehead. The robber then dropped the shotgun and bag, and fled the store. Police arrested a suspect and an accomplice later. They had not been formally charged as of Friday morning.

The whole process took less than 30 seconds, he estimated.

“....regardless of whether the shooter has a concealed weapons permit.”

Sounds like the honorable Islamic gent did not actually have a permit. Otherwise, he acted properly.

Then he is good from a legal point of view, but needs more practice at the range.

Although one should always aim for the center of mass, usually hitting someone in the forehead is also a successful strategy.

“he hit the suspect in the leg and forehead.

A grazing hit in the head with a .45 ACP is not going to drop the perp.

Contrary to popular belief (in some quarters), NO pistol round is a magic death ray.

Mr. al-Mujaahid needs range time.

Generally, with a .45 to the leg alone, one is not going to run or flee anywhere, and will likely drop where they stand. I would imagine even a glancing strike to the forehead with the same round, would be like getting hit in the head with 5 pound hammer.

Please DO NOT count on this happening.

Seriously.

The defender in this case fired "six or seven" shots, and achieved a forehead hit (certainly glancing, a solid forehead hit with a 9mm would decorate the opposite wall with brains) and leg hit. What happened to the other four or five shots?

They missed!

This is not a "minor caliber" (what a silly term!) problem, it's a poor marksmanship problem.

Important notes:

The video surveillance showed that the CCW holder first got his pregnant wife to safety, good move. He also fired some 7 rounds at the shotgun perp after the bad guy aimed the shotgun at him. Also a good move, laying down a lot of lead instead of shooting once and looking.

But the clincher is that this was the first time the CCW holder had been in that particular store, which is a huge irony:

“In a news conference Friday morning, Al-Muhaahid said it was fate that he was in the Aldi store when he was. He believes had he known that guns *were not allowed* in that store, he would have never shopped there — because of his concealed carry beliefs.”

Apparently, the Aldi store had a sign that guns were prohibited, and he didn’t see it, nor would have he shopped there if he had!

If he was "Islamic" it disrupts my premise that no Islamic should be allowed to be armed. It worked out well in this situation and maybe I need to be less "knee jerk".

At least it's not reported that he screamed allah akbar or whatever the hell it is that the pagans scream when killing people for their god.

I was thinking the same thing. 20 feet and the dude can flee? If there ever was an argument against a 9mm, that should pretty much end it there!

The sign on the store probably is an attraction to armed robbers and, fortunately, was not noticed by the armed citizen.

Come on. The only thing one can count on in these types of situations is the hope you're quicker than the bad guy, and hope the bad guy goes down first, without you getting killed in the process.

I was simply explaining to you the impact difference between 9mm and a .45. The difference is substantial and not even debatable.
