Liability waiver doesn’t get you out of criminal charges.
Looks like she will be getting a new to her car.
The waiver should NOT cover an idiot purposely driving over a teenage girl's car. Nasty chanting crowd, too.
“Broken-hearted” over a ‘94 Corolla? One doesn’t necessarily think of it, getting older as we are, but that’s a 19-year-old Japanese compact car! She’ll get the value of the car plus a substantial bonus to keep her from suing the driver, his insurer, and all the spectators for everything they’ve got, and she can buy a NEW Toyota!
It should also be on YouTube already!
Any parent who allows their 16 yr old to be at a monster truck mud pit bash at 3am has some questionable parenting skills.
i say just let her have his truck. She can then sell it on the open market. To me, if this were in the U.S., he could get time in jail for a criminal offense, and she could also sue for monetary damages. And since it was an intentional offense, perhaps she could get multiple damages.
“A private security guard reported seeing a large group of spectators gather round the vehicle at around 3am, urging two large trucks to run it over because ‘the owner doesn’t care’.”
1. Nothing good happens after 3 am.
2. The 16 year old may not care, maybe. But her family and the insurance company sure will.
General Rule of Thumb:
Avoid places that have REDNECK in their name... I appreciate them being honest about what they are, so there is no confusion.
Ladies and gentlemen, alcohol is not always your friend.
Well, I’m not excusing the drivers, or those who egged them on, but it’s not the smartest thing in the world for a young girl to be sitting drunk in a mud pit at the Redneck Yacht Club Swamp Cabbage Weekend at 3 A.M.
40 year old Norman Nowling of 15341 Will Lew Lane, Fort Myers FL was arrested and charged with felony criminal mischief. He was released after posting $2500 bond.
Norman Nowling, 40, of Fort Myers, was arrested for driving his van with five-foot wheels, over the car.
Witnesses say the van smashed both sides of the hood before driving over the entire car several times.
"It's tragic. It's maddening," says Paul King, Director of Marketing for Redneck Yacht Club.
King calls the weekend's car smash an isolated and unfortunate situation.
Management says Nowling isn't welcomed back to the club.
"Shocked, absolutely shocked that something like that would happen here where everyone is having fun. It's hard to even describe," King said.
Online, Nowling says he took out the car all in good fun.
He writes on the Redneck Yacht Club's Facebook page, "This is a big misunderstanding. Will pay for damages. Sorry this happened. Your car had been run over before I got there."
His arrest report appears to back him up. Security guards tell deputies that two other cars ran over the Corolla first, and when Nowling asked passersby if he could follow, they told him, "The owner doesn't care. You can do it."

We can all be glad we don’t live in Florida (although some do ‘exist’ there)
negligence can not be waived.
The person who did this are in deep do do.
