Pa. Court: Judge Uses Sharia Law to Free Muslim Assailant

In a shocking case out of Pennsylvania, an American judge has thrown out an assault charge against a Muslim immigrant based on Sharia law.

The assault victim was the head of the Pennsylvania chapter of American Atheists, Ernest Perce V, who was marching in a Halloween parade as “Zombie Mohammed” next to a fellow atheist dressed as “Zombie Pope.” The former depiction didn’t sit well with Muslim onlooker Talag Elbayomy, who then attacked Mr. Perce. And with an admission of guilt by the assailant and video of the incident, it should have been an open-and-shut case.

But that’s not how it turned out.

As Andrew McCarthy at National Review reports:

Magistrate Judge Mark Martin, a veteran of the war in Iraq, ruled that Talag Elbayomy's sharia defense — what he claimed was his obligation to strike out against any insult against the prophet Mohammed — trumped the First Amendment free speech rights of the victim.

Yes, you read that correctly.

Al Stefanelli of American Atheists provides some more information, writing:

The defendant is an immigrant and claims he did not know his actions were illegal, or that it was legal in this country to represent Muhammad in any form. To add insult to injury, he also testified that his 9 year old son was present, and the man said he felt he needed to show his young son that he was willing to fight for his Prophet....

The Judge not only ruled in favor of the defendant, but called Mr. Perce a name and told him that if he were in a Muslim country, he'd be put to death.

This is total BS! This judge needs to be JUDGED and impreached!!! This is America. We have our own laws. You cannot bring in a law from Peru and say it is okay to do something here. What if the thug killed the person? I guess under the scum law that would be okay also.

I have read that this “judge” has been moved in order to protect him from threats. Good.

May he live in fear of at least a good thrashing for the rest of his sorry life.

It brings up an array of really interesting legal questions and ramifications for society. If the judiciary is going to go w/ law du jour how could there be equal protection under the law? In fact, why even bother w/ a code since they’re really just making it up as the go. In the end its chaos w/ a thousand little gods ruling on whim.

Strikes me that the judge was more annoyed at Perce for being an atheist. And the judge is an Iraq veteran at that. Sounds to me like he needs a complaint before the Judicial Conduct Commission.

That occurred to me too. But it also came out that the judge spoke Arabic to the Mooslem defendant and his lawyer.

I wonder how many ‘secret’ US missions he intentionally scrood up over there. I wonder how many of our patriot boys and girls have been killed or maimed becuase of him.

Maybe he is whacked out?

What they were told at deployment (try hard not to cross the Muslims) doesn’t necessarily apply to civilian law at all.

I sure hope the plaintiff appeals this miscarriage of justice. This is America, not a Muslim country. If that Muslim cretin doesn’t like our system of laws, then he is free to go back to the oppressive, Muslim country of his choice.

Also against the rules, at least here in Texas. The prosecutor and I both speak fluent Spanish, but if I’m on the record, I can’t just talk with Spanish speakers without an interpreter. As a veteran myself, I (barely) feel for the guy, but he’s letting his experiences color his judgment inappropriately.

In a different article about this judgement it says the judge converted to Islam while in Iraq. So if you are hoping for equal protection under the law, you best make sure your judge is your religion.
