Get the POPCORN:

“You’ve seen the affidavit of probable cause. What do you make of it,” Smerconish asked. “It won’t suffice,” Dershowitz replied without hesitation.

“Most affidavits of probable cause are very thin. This is so thin that it won’t make it past a judge on a second degree murder charge,” Dershowitz said. “There’s simply nothing in there that would justify second degree murder.”

Dershowitz said that the elements that would constitute that crime are non-existent in the affidavit. “It’s not only thin, it’s irresponsible,” said Dershowitz.

Dershowitz went on to strongly criticize Cory’s decision to move forward with the case against Zimmerman. “I think what you have here is an elected public official who made a campaign speech last night for reelection when she gave her presentation and overcharged. This case will not – if the evidence is no stronger than what appears in the probable cause affidavit – this case will result in an acquittal.”

Smerconish identified the total lack of any mention of the supposed fight that occurred between Martin and Zimmerman prior to Martin being shot. He said he was disappointed that he did not see any mention of that conflict that led to Martin’s murder.

“But it’s worse than that,” said Dershowitz. “It’s irresponsible and unethical in not including material that favors the defendant.”

“This affidavit does not even make it to probable cause,” Dershowitz concluded. “everything in the affidavit is completely consistent with a defense of self-defense. Everything.”

I sent a hand written note to George Z today, care of his attorney. Honestly cannot begin to imagine the horror what he’s been through. Consistant with this pathetic administration of juveniles, good is now bad and vice versa. I’m sick of all the LIES and destruction.

Damn. Even a broken clock is right twice a day. Dersh may be a lib, but between this and him busting Obama for turning his back on Israel, my respect for the guy is growing.

The thing they’re actually trying to charge the guy with i.e. DOWW or Defending Oneself While White, would be an ex post facto law, which the constitution forbids.

Dersh needs to realize the thugs in power don’t care, and that they will kill the Jews first.

I believe the prosecutor did it deliberately because Zimmerman wanted her to charge him with SOMETHING so an official ruling could be made.

A judge throwing the case out is an official ruling that he is not guilty of anything.

I could be wrong(and I have been in the past) but I think Dershowitz is starting to get a dose of reality and he is realizing that the Democrates of today are taking him off the cliff. I always respected him, albeit never agreed with him or his politics. He always stayed true to his core beliefs. This administration seems to be more than he can tolerate and he is becoming more vocal. Good for him! Wish he was defending Zimmerman or at least on the team to defend him.

Isn't it amazing how the blatantly obvious is so controversial?

This is a naked attempt to placate Obama, Jackson, and Sharpton and take a campaign issue away from Obama.

If Zimmerman is drawn and quartered they will just move on to the next victim -- right up until a certain Tuesday on November.

I read the affidavit. It claims a fired casing was recovered. That disputes previous reports that the brass was still in the chamber. Sounds like a lie to me. The "affiant" also presumed to know what Zimmerman's thoughts were about Martin's intent...and stated his thoughts were "false". No bias in that report.

The defense is going to make swiss cheese of that sloppy affidavit.

I heard Levin read the affidavit today. I can't believe that the prosecutor said that Zimmerman said "They always get away" as evidence of his state of mind. The recording clearly shows that Zimmerman said "They always get away... [breath... breath]… from the back gate."

An honest listen will show that he wasn't lamenting that they get away, he was telling the police where to look for the suspect.

This is a dishonest affidavit. It's becoming clear that Zimmerman is being nifonged.
