Appeals court declines to take up voter ID case (WI)

Madison -- The Court of Appeals declined to take up a Dane County case Wednesday that blocked the state's new law requiring people to show photo ID at the polls.

The latest order is a further setback for those who support the voter ID law, and is another sign the law almost surely will remain halted for the May 8 primaries and June 5 recall elections.

Dane County Circuit Judge David Flanagan temporarily enjoined the voter ID law last month, saying the Milwaukee branch of the National Association for the Advancement of Colored People and immigrant rights group Voces de la Frontera were likely to succeed in their argument the law is unconstitutional.

A week later, Dane County Circuit Judge Richard Niess permanently enjoined the law in a case brought by the League of Women Voters of Wisconsin.

The state Department of Justice appealed both decisions, to two separate courts of appeals. Both appeals courts said the cases should go directly to the state Supreme Court because of their statewide importance, and the appeals courts did not render opinions on them.

But the Supreme Court this month said it would not take either case, sending them back to the appeals courts.

By then, the trial in the NAACP case was under way. The Waukesha-based District 2 Court of Appeals ruled Wednesday that it would not take up the case because of its procedural posture.

Flanagan is expected to rule on the case sometime after mid-June. Either side can appeal the case, and at that stage the court of appeals will have to take the case because there will be a final ruling.

So there may be some evidence to pursue including fingerprints on ballot if the DA is so inclined.

You watch too much CSI. Everybody on God's green earth touches that ballot, starting with Juan, the illegal alien working for the print shop. (I watch too much as well)

I would think that those who are seeking state and/or federal benefit payments of any kind would have to have some kind of photo ID. After Ike destroyed some of my property I applied to FEMA and SBA for a low interest loan to repair my business property. The forms could be sent by mail to an office in Florida which was handling Texas claims but I had to send a copy of my driver’s license, picture ID and a copy of the letter from IRS which contained my business tax ID number. It just seems strange that all government agencies require that you prove who you are for everything but voting. Makes absolutely no sense.

It could. In fact, I’ve seen it happen. I don’t think it was intentional, but I was at the sign in table when one of the ladies who was minding the book checked off the wrong name. That is the reason that (in Mequon, at least) we have 2 clerks on the books at all times. In any case, somebody checked off the wrong name. When the person came into vote, one of our books said that that person had already voted.

After a little kerfluffle, we back tracked and found the mistake. If we hadn’t been running 2 books, that voter would have been out of luck.

Now that the voter has to sign one of the books, I don’t think that it would be as easy to make such a mistake — UNLESS it is intentional. The voter would not sign over the wrong name, unless he/she means to.

You cannot enter a Federal Courthouse without showing picture ID.

How is it that the Courts can “discriminate against minorities” in allowing access to courthouses and Federal buildings by requiring photo ID, but the states cannot require it for entrance into a voting booth?

How is this a good thing? A Dane County peon district Judge Flanagan temporarily ruled against voter ID, then a 2nd peon Dane County district Judge Richard Neiss ruled a permanent injunction against voter ID, then 2 Appeals Courts refused to rule on it, then a chickenshit WI Supreme Court refused to hear the case and kicked it back to the two Appeals Courts who refused to hear it earlier, and now say the EARLIEST they could hear the case is in mid-June, well past the June 5 recall election.

So how would voter ID be reinstated before June 5, given these circumstances and court rulings? There is absolutely no way the WI Senate or Assembly will pass a 2nd version of voter ID if this is running into all these court rulings against it. Personally I wish the Gov Scott Walker would issue a governor's executive order, declaring these rogue judicial rulings to be null & void and mandating that all election precincts must enfore voter ID or their precincts will not be counted. At some time, we have got to stand up against these bastard rogue judges who continually rule against the rule of legislative law, and instead make themselves to be the official purveyor of law according to them. We need an American Revolution II now more than ever.

I can empathize with your situation.

As a retired law enforcement officer, although that has no bearing in my case since I only seek to be treated like any American citizen who is afforded Second Amendment Constitutional rights, I found my recent purchase of a firearm very interesting, especially in view of the passage of the voter ID law in Wisconsin, only to be vacated by a variety of activist judges.

In short, I haven’t purchased a firearm for probably 20 years. When I made the purchase at a local franchised store, I was first asked to show them my photo driver’s license. I was then required to complete 3 forms of information. Apparently, one look at my photo driver’s license didn’t do the job because I was asked to produce my license a second time so a background check could be run, at my expense of course.

The sales clerk then advised me that I could pick up my firearm after 48 hours transpired. I questioned her about the waiting period because the last time I bought a firearm, the waiting period was 3 days. He advised the change was made more than a year ago.

Skip to 3 days after my purchase (I was unable to pick up my firearm after 48 hours because I was out of town) and I approached the same sales clerk who remembered me, but asked to see my photo driver’s license a third time, finalized a document she began when I initially came in to purchase the firearm and then carried the firearm up to the checkout lane where I paid for it.

I know she was following store protocol, but I was tempted to comment that the store policy makes it impossible for a citizen who doesn’t have a photo ID to purchase a firearm, even though none is required for voting purposes.

I am ashamed to admit I was born and raised in Madison, but during my youth and young adulthood, Madison actually had judges who made judgements according to the law rather than basing their decisions on a skewed political agenda.

As effed up as the system is, YOU'LL probably be the one charged with vote fraud.
