This is not even remotely controversial. One of the hottest fields for training in the law today is the area of social media an electronic discovery. Criminal and civil lawyers routinely discover Facebook, MySpace, and other posts and publication by parties in a case. If the media treats this as controversial or aggressive on the part of the defense counsel, it just tells you they do not know of which they speak or write.
