I’m Not Down on John Roberts

. . . I get the strong sense from a few anecdotal stories about Roberts over the past few months and the way he has written this opinion that he very, very much was concerned about keeping the Supreme Court above the partisan fray and damaging the reputation of the Court long term. . . .

Second, in writing his case, Roberts forces everyone to deal with the issue as a political, not a legal issue. . . Third, while Roberts has expanded the taxation power, which I don’t really think is a massive expansion from what it was, Roberts has curtailed the commerce clause as an avenue for Congressional overreach.

What kind of tax is it?

I was thinking about this very thing. To me, it most resembles a civil fine.

I read the the opinion. Its a disaster. “First, and most importantly, it is abundantly clear the Constitution does not guarantee that individuals may avoid taxation through inactivity” (Page 41) “The Federal Government does have the power to impose a tax on those without health insurance.” (Page 44)

Roberts is just part of the machine that was built to destroy this country. He has fully revealed himself this week.

The precedent has been set. The United States is gone.

Oh the irony of Robert’s claiming Congress is the body that is charged with passing unconstitutional legislation.

You’re the idiot. Where did he say Congress can tax nothing? He said that Obama care IS A TAX, a fact that Obama and his minions expressly denied, saying it was passed under the commerce clause. If I understand this correctly the ball is back in Congress’ court, they can hold it there until next January.

I just got an email from Sen Cornyn and the NRSC. It talks about getting a majority and repealing obamacare.

It doesn’t even mention the need to break the “filibuster”.

If I were cynical, I’d say that this is exactly what the “conservatives” in Congress want. They want the liberal agenda to advance slowly, so that they can rail against it and ensure their re-election...but not really do anything about it. Ineffectively railing against socialism but doing nothing is the right’s version of racism.

Does Cornyn reall want to repeal obamacare? Again, if I were a cynic, I’d say, “nah...what he wants to do is raise money by calling for repeal”.

Yes, of desperate, convoluted reason. Roberts has sanctioned the most despicable, behind-closed-doors, partisan Congressional bill in history, one that could not have passed but by bribery, kickbacks and betrayal of the so-called pro-life Democrats, one that is massively opposed by the majority of the public. It gives the Pompous One an advantage in November. The next election will indeed be about judges, as 3 of the current judges are nearing retirement. It is impossible to rationalize anything good about Robert’s own constitutional betrayal. Maybe he didn’t want Obama to criticize the court in his next State of the Nation speech. Anyway you look at it, today was a tragic day for our constitutional republic, and Roberts has sealed his reputation for all time.

This decision has made it possible for the government to tell every property owner that they MUST have solar panels installed and operating or pay a fine.

This must be overturned...

Actually our tax system already functions this way. If I do not buy a house on credit or have children or pay college tuition, my taxes are higher.

OK. YOU explain why this is not an insane, destructive decision. Millions will be forced to accept substandard care. Millions will either lose their businesses or be thrown out of work thanks to this madness. Most of us here have had time to reason this whole abominable law through. Roberts is NOT some genius smarter than the average American, but a coward who refused to uphold the Constitution. He is a disgraceful man. Bob

Thanks for your opinion, but its more likely Alito, Scalia and Thomas (and Kennedy!) were the 'voice of reason' here.

LOL Except that it isn’t a tax because it cannot be defined as one.

Is it:

A Sales tax? No. no sale here.
An income tax? Nope no income here.
An investment tax? No investment either.
A death tax? Nah.
A corporate tax ? Nope. it is on individual as well.
A real estate tax? no.

Well what is such a thing as this if it is not a FINE for not purchasing something that the government ORDERS you to buy as a consequence of living in America?

It walks like a duck... not a tax
