Aide: Romney sees mandate as a penalty, not a tax
Associated Press ^ | July 2, 2012

WASHINGTON (AP) - A top adviser says Republican presidential candidate Mitt Romney doesn't see the health care mandate as a tax but as a penalty or a fee or even a fine.

That's a different view from Republicans who are condemning the individual mandate in President Barack Obama's health care law as a tax instead of a penalty, as Obama prefers to call it.

If the state can tax you, and jail you for non-payment, for merely existing, then we are no longer a free people but slaves of the state.

That John Roberts does not see that is an indictment of how far away from the constitution he has moved.

Yes it’s a mandate which makes it unconstitutional BUT now that Obama lawyers were saying it was a tax in oral arguments and Roberts said it was a tax and it being passed in the SC in Obama’s favor - Romney could have hanged Obama by the skin by talking about the largest middle class tax hike in history which makes Obama a liar (we had Freepers celebrating that ObamaCare being called a tax would guareentee Romney the election) - Romney, through his aide has completely taking it OFF the table in trying to defend RomneyCare and the average voter doesn’t care if both sides are arguing over the semantics of Mandate here and Tax there and who said what but they clearly understand what a massive tax hike is

Mitt is dumb

People know this is bad, let's keep the focus on 0bama. It doesn't matter. We can kill this with reconciliation but we need majorities and the White House.

McConnell said today that the odds of Obamcare being repeal is not in their favor - I always question if the Republican Party in D.C. was really serious about repealing it. Yes, they have said so but we have seen them back off numerous of times and still expect conservatives to fall in line eventually

Under Obamacare the 15000 new IRS agents do a lot more than collect the penalty.

And the payment that you have to make only if you fail to comply with a government mandate is in fact a penalty. Prior to Obamacare, there was a long line of cases defining “Tax” and a selective penalty only applied to those who do not comply doesn’t fit the definition.

However, whether or not it is a tax or a penalty, the process by which it can transform a federal government dictate to participate in interstate commerce into something constitutional is still a mystery.

Can’t disagree with that. But I’m sure that the Romney campaign and the PACs will follow the “it’s a tax” strategy in their ads.

It’s everything; a mandate, a tax, a ransom, extortion and an attack on our personal liberty.

Need to drag this idiot over the finish line, stick pen in his hand, get rid of Obamacare. Then impeach him.

That is the best comment ever made by a ABO’er.

It is all BS. The libs on the court (excluding Roberts) did not care a fig for what it was called. Even the concurring opinions used penalty but figured that if Roberts needed the fig-leaf of calling it a tax - they could concur - not agree to the description just to the result.

The Russian communists called themselves Bolshevik's (the majority) even when they were not. The ruling group was called mencheviks (minority) even when not.

During the constitutional debate over granting taxing powers to the government, the Nationalists called themselves Federalist (even though they weren't) and the opposition was called anti-federalist (even though they advocated for federalism.)

Progressives use labels that sound good to the public not necessarily accurate ones.

Gay, pro-women, culturally sensitive, inclusive, colorblind ( as they continue to collect data on “race” fill quotas on gender, race, even non-gender or multi-gender.

My grandparents and parents fought wars, gave up immediate gratification, struggled to let me grow up in a Ozzie and Harriet world. Sure there were Ike and Mamie but the federal government was not an everyday presence in our lives. You could open a bank account with a few cents and get a nice deposit book without a SSN. The Christmas account did not show up on someones 1099 to report to IRS. I traveled across the city of Hartford Ct to visit relatives by foot, bike and sometimes bus.Today you need a convoy with heavy firepower.

I regret that I cannot provide the same to my grandchildren except in really small towns in rural America - for those wonderful communities I give thanks.

As long as we work to to bring small-town America back to favor at least I can bequeath the ability to struggle and fight back to my grandchildren.

I can hear the republicans now. “Well, it IS a tax. We’ve been saying it’s a tax. The SC ruled it’s a tax. So we’re not going to appeal it. Thank you for your votes.”

Part of being conservative is not counting your chickens before they're hatched. We need to net several seats in the Senate and also beat Obama. What do you want McConnell to say? That it's in the bag?

Romney got stuck with this position when he said he agreed with the dissenters (Scalia, Alito, Kennedy and Thomas). Their dissenting opinion ruled that the mandate was a penalty and could not be a tax.

Mitt Romney: For use when lying and looting just aren’t quite enough to bring conservatives into the fold.

” - - - Need to drag this idiot over the finish line, stick pen in his hand, get rid of Obamacare. Then impeach him.”

To much risk that Obama will beat “The RINO” again.

Just DUMP Romney with an ABSTAIN first Ballot in Tampa. Vote, broom, done.

Romney was handed this election on a silver platter when Traitor John Roberts destroyed the boundary between the Judicial and Legislative Branches of Government last thursday.

Romney steadfastly refuses to embrace this building animosity toward Roberts and Obama”care.”

if Romney wants to play prep school politics while our Nation is being torn asunder by a Rogue Chief Justice and a foreign-born Bolshevik White House Occupier, then thank you Mr. Romney, don’t call us, because we are going to DUMP you!
