This is not a case of murder. It never has been. This was the act of terrorism by a traitor. If they want to play games of courts and ‘justice’, then give him the orange suit and a plane ride to Gitmo. Try him for treason there, then hang him.
Don’t force 12 officers who have sworn to defend this nation from the likes of him to sit in judgment, to listen day in and day out as he breathes, and his fellow soldiers rest in their graves from his traitorous act. There’s no chance of innocence - he shot and killed uniforms. He wasn’t targeting anyone specific, nor a specific group. Simply going after fellow soldiers with guns, in a place he knew they would be unarmed.
The defense will certainly do its best to exclude any officer who’s served in Iraq *or* Afghanistan,that’s for sure.I’ve been out for a long time and never ran afoul of the UCMJ so I know little about courts martial but isn’t a unanimous verdict required to pass down a death sentence?

A General Courts Martial Board, for Death to be handed down, must all vote yes.
Seems to me that the defense would be best served by using an insanity defense.One could argue that there are certain brain injuries/disorders that might cause one to commit such an act but might absolve one of moral and/or legal responsibility.
And no,I'm not saying that's the case here.If I was on the panel the only way I'd even *consider* an insanity plea is to see an obviously abnormal brain scan or irrefutable evidence of some sort of major head trauma,etc.
No jurors required.
A six man firing squad will do fine.

Any JAG oficers here? I didn’t think there was jury screening, except actual conflict of interest, in picking a military Court. There is no jury per se, in a military trial, there is “The Court”, a panel of officers (and enlisted if the defendant is enlisted and requests enlisted members, which most wisely do not) They are appointed by the convening authority, and are on special orders. The judge is there to advise the Court on the law. The head of the Court, that is the senior officer on the panel, is in charge of the proceedings.
Forget what you’ve seen on “A Few Good Men”, or any Hollywood representation of a civilian court. Military trials/courts are different than real civilian courts/trials, and even more different from the Movie/TV versions of those.
I don’t understand why they didn’t forcibly shave Hassan, and cut his hair to be within military regulations. He is still a Major in the US Army and thus still subject to military discipline. In fact he’s supposed to appear in court wearing the appropriate uniform.
Fair Trial in Texas?

Let The State of Texas try him for a civilian death. Problem solved. We will save the nation a lot of BS.

Even if the charge were treason, as it should be, there would still be a trail.
Military courts are not so large as civilian juries, so I doubt there would 12 officers on the panel. Five is the minimum number for a General Court. One murder trial I just looked up had 8 members, and that may have been larger than usual, since the defendant was a Marine Corporal, and had 4 officers, two warrant officers and two enlisted members on the Court.
I was wrong about screening the members of the panel, the process is similar to the civilian courts, including pre-emptory challenges. One each for the prosecution and defense. The Judge will have to decide on an individual basis. As to a ‘change of venue”, the members of the Court are supposed to be from the same command as the convening authority, and the accused.
But either treason or just murder, the dirt bag will be found guilty. Unfortunately we’ve given up the noose and even the firing squad.. leaving the Needle. That’s too good for Hassan, but that’s what he’ll get.
I’d serve on a firing squad, but I’d have to stand in line for the honor. I’d even supply my own rifle and ammunition.. I have plenty.
I came accross an old army manual for executions. Really too bad we don’t do the rope or rifle thing anymore.
