[snip] the phrase "Well, here's another nice mess you've gotten me into!" pretty well sums up EPA director Lisa Jackson's decision to enforce the EPA rule that mandates that oil refiners blend cellulosic ethanol into gasoline, diesel, and jet fuel, among other products.
The nice (or fine) mess? Cellulosic ethanol does not exist commercially! It exists in small quantities in labs, but there is simply no way for oil refiners to honor the EPA mandate. But did that little problem cause Jackson to change her decision? Nooooo, to quote John Belushi on SNL.
The EPA fined refiners a $6.8-million penalty for not following its edict. The American Petroleum Institute (API) and the American Fuel and Petrochemical Manufacturers (AFPM) in February 2011, and, in January 2012, appealed the fine and asked Jackson to review her decision. She refused to reverse her decision, then had the gall (and bad taste) to close her refusal letter with "We thank you for your interest in these issues."
"EPA's decision is arbitrary and capricious. We fail to understand how EPA can maintain a requirement to purchase a type of fuel that simply doesn't exist," said Charles Drevna, president of AFPM.
That $6.8-million fine, if oil companies are doing their job (and they had better, since I am a stock holder), will be passed on to consumers -- that's you and me. So, ultimately, we will pay $6.8 million to the EPA because of Jackson's stupidity.

Since 1992, MTBE has been used at higher concentrations in some gasoline to fulfill the oxygenate requirements set by Congress in the 1990 Clean Air Act Amendments. Unfortunately, the “experts” at that obscenely inept agency didn’t know that MTBE in run-off water would poison the ground water. Gas stations had to dig up their tanks and replace them to keep this contamination from happening....at their expense, of course. Many couldn’t afford it and went out of business.
The EPA should have been terminated long ago for egregious errors such as this. Instead, they double down on their regulations, bury the “unintended consequences” to our economy, and keep cashing their very generous taapayer-funded pay checks.
Maybe it is time for us to force the government to give us things that do not exist.....
But bureaucrat Regulator can run wild to their hearts content and only the person who approved their appointment can slow them down.
Don't worry so much about the law. IT”S THE REGULATIONS and regulators that kill you.
Taken further, the EPA could PROHIBIT the production of fuel w/o Fairy Dust. Using the selective enforcement that so defines the EPA & the Justice Dept., they could shut down any fuel producer they wanted. What is to stop them?
In a second Obama administration, the EPA will assume god-like powers over all our lives.
I have some to sell, it is still in tree form, but that shouldn’t be a problem to EPA.
Obama is using the federal bureaucracy to raise campaign cash.
Yet another crime from the lawless Obama administration.
Its almost like they are all in kahoots against us.
That right there is the reason for the Lefts celebration. The health decision means nothing
in the grand scheme since now they have court authority to tax willy-nilly on life itself based
on a simple and maddening public need.
I can't think of anything else to do accept impeach Roberts and make a constitutional amendment
that would even further degrade the Constitution into historical abyss. We may win this election
but the RATs will have a "next time" and will be hell bent on hammering in the final nail.
Stopping this will take unprecedented balls of courage by the Republicans which they have not
shown since Reagans leadership era. Starting with dismantling the EPA and other unelected
forms of Government that control our lives from the unseen sewers below the law.
Taking down those entities must be done the first months of the first term of the next President.
Doing so would insure that it would take at least a decade to reinstate those
institutions of Statism while the voters get to watch the haste to reinstall those
unelected offices by the Dems firsthand. Those institutions have been created over a century in a slow
unimpeded drip by means of asking for 100% and settling for 10%. Well, that 10% has turned into 100,000%
now and that clock must be turned back.
