Mother sues police over son's accidental shooting

SAN FRANCISCO (AP) — The mother of a parolee who accidentally shot himself to death during a gunbattle with San Francisco police is suing the city for failing to give him immediate medical care.

The San Francisco Chronicle (http://bit.ly/Qewm5g ) says 19-year-old Kenneth Wade Harding didn't pay a Muni light-rail fare and was running when his gun fired and the bullet pierced his neck last July.

He was trying to shoot at officers at the time.

That sex act took place at Harding’s house while he was under home detention for an armed robbery.

That would be a fair punishment only as long as his new home is longer than it is wide, and located just a few feet below the soil level.

What country in the world would hate its law-abiding citizens so much that it puts an armed robber under house arrest? That guy was just moments away from becoming a murderer.

What's happening here is that the most violent part of the society is successfully changing de-facto laws as it suits them, by the threat of riots. Lacking proper tools of punishment (any caliber will do,) the police is just feeding the revolving door of the prison. Criminals are rendered safe only when they kill themselves, or when their associates do this public service. Even in jail violent criminals continue their life of crime, in part by terrorizing small-time, nonviolent offenders - who have nowhere to go. This society lost their will to live since it no longer wants to protect itself from members who are unfit to exist.

exactly why we need tort reform.

a parolee and carrying a gun? shouldn’t have had it in the first place. honest law-abiding citizens have a hard enough time to be able to carry a firearm.

lawyers that would bring this to court should be tarred and feathered and lose their license. tired of listening to all these liars (opps, should have typed lawyers), in commercials trying to drum up business with their ambulance chasing ads.

i am not a real big fan of the police, but there are some good ones. the perp got what he deserved. why should anyone pay for his medical expenses and then pay 50,000 a year to incarcerate him again?

Tort fix #1: Courts shall have the power to seize no more than $100 without legislative approval of a higher fine. Just shut the door on all of it. I'm sure it'll be an emotional battle in the legislature to put a value on a human life while at the same time approving wholesale destruction of human life in the abortion mill, but hey, you loot the taxypayers for your feathered pensions and health care, you might as well make SOME tough calls.

Tort fix #2: Any seizure of more than $1,000,000 requires legislative approval of the award. The ultimate appeals process - have legislators approve these incredibly high judgments.

Personally, I prefer fix #1. Cap it from the start, then go through and assign limits based upon actual legislated law rather than whatever the court has decided over the years can be used as the excuse for a lawsuit.

i agree with one exception.

i would fine lawyers for bringing spurious cases to court, and i would allow the winner to collect legal fees from those that bring these cases to court.

I think maybe you don’t know lawyers very well. A good samaritan law won’t prevent a lawsuit from going forward if the contention also exists that the good samaritan was the primary cause of death, to wit: bullets from his gun.

What, by the way, is really crude stuff?

BTW, you can sue anyone about anything you want at any time in any court.

There are lawyers who are happy to do so. Most of them would prefer to win so sometimes they'll talk you out of it ~ 'cause they don't see a chance for a fee
