Jared Loughner, the young Tucson man accused of shooting Rep. Gabrielle Giffords and killing six people, is set to plead guilty Tuesday, an official familiar with the case said Saturday.
A psychologist appointed by the court is expected to say at the hearing that he is competent to plead guilty, the official said. A previously scheduled status hearing has been changed to a change-of-plea hearing.
In February, the psychologist said Mr. Loughner, a diagnosed schizophrenic, remained incompetent to stand trial. But she said at the time that the defendant was making progress toward competency, according to federal Judge Larry A. Burns, who is hearing the case.

I didn’t see mention of it in the article. It was a brief article.

My guess is that would be the absolute maximum.
I'd be surprised if he pleaded guilty without a deal to avoid a sentence of death.

Under Federal law, he cannot receive the FEDERAL death penalty, 18 U.S.C. 351 would not apply.
However, he still can be charged under capital murder in Arizona.

One wonders, then, what sort of deal has been worked out for Mr. Loughner. Perhaps it's been coordinated with state prosecutors to avoid a capital charge from the state of Arizona.

Maybe he could under 18 U.S.C. § 1111. I have never heard the federal govt charging someone with ordinary murder.

Why isn’t he eligible for the federal death penalty? He killed one federal official and attempted to kill another. Is it because the one that was killed was not acting in an official capacity and that Giffords who was in an official capacity (having a “congress on the corner” meeting) wasn’t killed?

There’s a high likelihood that the guilty plea will be a plea of guilty by reason of insanity.
I think life without parole in the GENERAL PRISON POPULATION....
would be acceptable...
