Ala. man fights to keep wife buried in front yard

James Davis is fighting to keep the remains of his late wife right where he dug her grave: In the front yard of his home, just a few feet from the porch.

Davis said he was only abiding by Patsy Ruth Davis' wishes when he buried her in 2009, yet the city (has now) sued to move her. A county judge ordered Davis to disinter his wife, but the ruling is on hold as the Alabama Civil Court of Appeals considers his challenge.

Davis, 73, said he never expected such a fight.

Isn’t there a concern for groundwater filtration, etc.

Apparently not. The body is interred in a casket, in a burial vault, much the same as done in any cemetery.

According to the article, "After his wife died on April 18, 2009, the City Council rejected Davis' request for a cemetery permit. The decision came even though the county health department signed off on the residential burial, saying it wouldn't cause any sanitation problems."

One of my relatives had a slab installed on top of his wife’s grave to prevent her return. Apparently he was serious.

The next purchaser of this beleagured man’s home would probably prefer it to be human-corpse-free.

Bah. In some parts of rural NC you can't drive 20 miles without seeing a farmhouse or a field without a small family graveyard near it.

I like it that way! I think its important not to hide graves away.

As a child I played bible school softball in a field where 3rd base was a grave marker. Old graves of people that I never knew, but that shared my last name was a quiet and powerful reminder that I had family that came before me and that there will be more after me... and each day is a gift!

I think she needs to go to a cemetery. First of all he will have a difficult selling the land if the body is on the land later on (or his family members). The new owners could never do any remodeling or anything with a body buried in the yard. It is dumb to have bodies buried in personal yards. The problems with that are just overwhelming.

If you select Broad Street, Stevenson, Alabama on Google Maps you will see that the houses are on small, suburb sized lots. There is not much acreage separating the houses at all. The town council might have it right, even though his heart is in the right place by submitting to her final wish.
