Hunters shoot at gun thieves in restaurant parking lot(TX)

SAN ANTONIO – Hunters hoping to enjoy the first day of dove season instead ended up using their guns on suspected car thieves.

The hunters were eating inside the T.G.I. Friday’s restaurant off of Loop 410 and Highway 151 on the west side.

Police say they looked out the window and saw thieves breaking into their pickup truck. The smash-and-grab left glass shattered across the parking lot.

Officers say the hunters ran out of the restaurant and told the thieves to stop but by then, the suspects had stolen about five handguns and shotguns and jumped into an SUV.

Police say the hunters are conceal-carry permit holders and quickly took action: they pulled out the guns they were carrying and shot at the getaway car.

"They're reporting they fired at least four to five shots into the SUV vehicle,” Sgt. Steve Priori says. “It's unknown if anybody was hit."

Handguns are for defense against wild hogs.

I like it; Russian style.

No, keep them close. They are no good in a bad situation in the trunk.

Not good to leave weapons in plain site in a parked vehicle. That doesn’t justify the robbery but it surely puts the items in plain site for criminals.

......
The pair broke a rear window on the driver’s side and took “at least four, maybe five weapons — handguns and shotguns” that had been left in plain view on the back seat and the floor of the pickup, Priore said.

“Texas allows more freedom of action to use force to protect property than many other states.”

John Locke’s trilogy of life, liberty, and property. Those should be the things deadly force should be employed to protect.

Yeah, in Colorado you or someone must be in imminent danger of loss of life or dangerous injury. You can’t shoot at someone who is running away from you just because they have your stuff.

Use of deadly force is permitted to recover property in Texas, but you have to read it carefully:

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:

(1) if he would be justified in using force against the other under Section 9.41; and

(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or

(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and

(3) he reasonably believes that:

(A) the land or property cannot be protected or recovered by any other means; or

(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

Sorry for the formatting, I didn't bother to enter all the HTML to make it look right. You can find it online here:

http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.9.htm#9.42

The important thing to note is the "during the nighttime" pre-requisite only applies to theft. Since they broke into the vehicle, it was a burglary -- which doesn't have the nighttime qualifier.

That said, I don't think it was a good idea to shoot at the fleeing vehicle. Too many things could have gone wrong, and the shooter would have been held responsible.

That’s basic loadout for a Texan .....:o)

There's an old story (probably true) about a Texan who was pulled over by a cop.

As required by the law, our friend announced that he possessed a CHL and was packing. He then went through your list when asked to tell what hardware he was toting.

The somewhat stunned cop then asked, "What in hell are you afraid of?"

"Not a f___ing thing," the Texan replied. "Not a f___ing thing."

“I must have missed the wild frenzy part.”

I was referring to the cops in NYC that recently managed to hit 9 innocent people while apprehending a perp at the Empire State Building that killed his boss. My point was that the cops can get away with it. Average Americans who accidentally shoot innocent bystanders will not, and the DA, media will chastise and Zimmmerize them just to make gun owners look bad. Thank God it worked out.
