Obama wins right to indefinitely detain Americans under NDAA

A lone appeals judge bowed down to the Obama administration late Monday and reauthorized the White House’s ability to indefinitely detain American citizens without charge or due process.

Last week, a federal judge ruled that an temporary injunction on section 1021 of the National Defense Authorization Act for Fiscal Year 2012 must be made permanent, essentially barring the White House from ever enforcing a clause in the NDAA that can let them put any US citizen behind bars indefinitely over mere allegations of terrorist associations. On Monday, the US Justice Department asked for an emergency stay on that order, and hours later US Court of Appeals for the Second Circuit Judge Raymond Lohier agreed to intervene and place a hold on the injunction.

The stay will remain in effect until at least September 28, when a three-judge appeals court panel is expected to begin addressing the issue.

On December 31, 2011, US President Barack Obama signed the NDAA into law, even though he insisted on accompanying that authorization with a statement explaining his hesitance to essentially eliminate habeas corpus for the American people.

In college I studied Russian political history and literature and came to understand, all protestations to the contrary, that it in fact could happen here, not because Americans were potentially susceptible to the statist impulse, but because human nature desires normalcy and reflexively denies that which threatens it. Too many people sacrifice the difficult reality of freedom for the false comfort of dependency.

Actually it was an Act passed by congress. That why its called the National Defense Appropriations Act. The act included funding for the DOD along with this treacherous crap. I was emailing the so called republican conservatives, including Allen West, like crazy to vote it down. AKA Indefinite Detention. What’s the English word for “Gulag”?

True. I find it disturbing that there are so few who find this disturbing. Of course the Habeus Corpus suspension is/was a logical outcome of protracted, definitionally-unwinnable warfare: War of Terror, War on Drugs, War on Poverty... what are the "victory conditions for any of these? Moreover, are those even desirable goals? [i.e. defeating poverty by taking all that everyone has (theft), thus making everyone all the same.]

My error. I seem to recall he had personal input somehow with that. Is it he and Holder are responsible for that language about detainment? I probably have that info. in an email I sent to a friend at the time this became effective. I want to know for myself where I got that, so I’ll search emails. Thanks for the clarification.

I don’t know why the bold type, as if it’s supposed to be a surprise. SCOTUS never overturned Korematsu, did it? And if it did the president could ignore SCOTUS like Lincoln.

You remember correctly. The argument was about language. Obama actual wanted more aggressive language in it which the original bill from the Senate contained. Negotiations reduced it to the treachery that is now law. Hard to imagine it could have been worse.

Searched my emails. Two acts happened at the same time or within one or two days of each other. That law was passed and the following executive order was written/signed within a day or so of that law. I sent a friend an email about both at the same time. I was recalling them now as both being executive orders, which was in error. Here's the email I sent about the executive order:

“President Obama signs Executive Order allowing for control over all US resources

On March 16th, President Obama signed a new Executive Order which expands upon a prior order issued in 1950 for Disaster Preparedness, and gives the office of the President complete control over all the resources in the United States in times of war or emergency.”

There had been an executive order that was similar, but he added “or emergency” and when listing what they could take, he included more items basically meaning you might have your shorts left when he was through taking from you.
