It would seem that recording was illegal and if so the person who made the recording should be prosecuted.

Florida is a two-party consent state...so to legally record at this function, either Romney/staff or event hosts had to consent before any audio recording.

No consent = Law was broken.

You can video record without consent in Florida, but not audio

Whoever recorded it, God bless him. IT'S THE TRUTH. And economically disastrous government dependency vs. healthy free enterprise is a good, strong argument.

What Mitt needs to do is reach out to those 47% dependent on government because there are certainly a fair % that don't want to be on welfare - he can reach those people.

“Holder and the U.S. In-Justice Department?
The Cowardly GOP House?”

Being that we are talking about a state law, Holder and the House GOP would have no power in the matter.

However. A Florida prosecutor would have such power.

Didn't you get the memo?

Anything that's beneficial to libs - legal.
Anything that's detrimental to libs - illegal.

Pretty simple, really.

Figures, loser: Jimmy Carter’s Grandson Helped Spread Romney Video September 18, 2012 According to the article, this is his Twitter account: Oppo researcher; political junkie; news sponge; policy wonk. Currently looking for work… Seriously, give me a project. Atlanta, GA More details at the Daily Intel. Losers and apples never fall far from the tree. Credited as a “research assistant” on the story is James Carter IV, the grandson of former President Jimmy Carter, who has been toiling online as an opposition researcher and is “currently looking for work,” according to his Twitter bio. “I’ve been searching for clips on Republicans for a long time, almost every day,” said Carter this evening. “I just do it for fun.” But by connecting Corn with the mysterious uploader of the clip, Carter has uncovered his biggest story yet, one that could potentially affect the outcome of the election. You don't have to donate money to make a difference.

If You Live in a Blue State, Here Is What You Can Do To Help Romney Beat Obama

I've made 1600 phone calls from home to NH in the last six days using the system set up by the campaign. Even 100 call will make a difference. Who will join me?

That's pretty thin ground. He was at a fundraiser if I heard correctly.
We would laugh at the other side if they used this as a defense.
We would look like asses to sue them.

Romney needs to instead go on the offense and flesh out the message he was delivering when he said this.

Nobody has to pursue anything on a legal basis.

Just discredit the purveyor of the information.

Democrats have done this successfully for decades. They don’t deal with the information, they just attack and destroy the messenger.

So next time the subject of the video is brought up, just ignore the content and switch the subject to the illegality of the video.

I don’t know what happened to the Martins, but Jim McDermott, whom they gave the tape to and who then released it to the NY Times was sued on principle for $1.00 and lost.

The video purportedly shows Obama making inappropriate comments at a Jihadi fundraiser; the LAT admits it has it, but won’t share it with us.

Weren't the Democrat activists who illegally tapped/taped Newt Gingrich's phone call to his attorneys from Floriduh?

If I recall, they were slapped on the wrist with a $500 fine.

Deja vu all over again. Where were Gingrich and Boehner recorded?
Oh, yeah. It was:
http://www.pbs.org/newshour/bb/politics/jan-june97/cellular_01-14.html

At the same time the Martins were on the road so was Congressman John Boehner, a top member of the House Republican leadership. He was driving through the Lake City area, the last leg of a trip from his home in Ohio, to Marco Island off of Florida’s West Coast. But then Boehner pulled off the road and picked up his car phone to join a conference call.

I wonder if Romney would even want that to happen. However, the recording was done in the home of a billionaire, from what I understand. So, I’m thinking he would have the right to press the issue legally; and, this guy has the money to push this thing until there is an arrest and prosecution.

Those who published it, and the Mother Jones Reporter, would initially refuse to give up their “source” and it would not be settled before the election; but someone would eventually be thrown under the bus for this.

....was it really Jimmy Carter’s grandson?

I've heard this also.

It would be more effective if the Romney camp confirmed this and then start a media blitz of asking jimmah if he approved of what his grandson did, especially since it's illegal to tape in Fl without both subjects knowledge and consent.

That would embarrass the bejeebers out of carter - and make him a laughing stock - which would turn the whole thing around. For one thing, the media lapdogs would shut down the whole subject of the Romney tape real quick

True, especially because the "bitter clingers" comment was made/recorded in California, which is also a two-party consent state.

It will be tricky. In Maryland they have a condition that the situation indicates that you have a reasonable expectation of privacy to make that charge. A private fundraiser by invitation might meet that, or not. How did he get in?
