This is heartbreaking to read. I can't well but wonder if Mr. Mashburn would have survived if help had arrived sooner.

I'm acquainted with the family. They are good people, strong Catholics. Please pray for them.

um... I am confused... if he could make multiple texts and honk the horn... why couldn’t he use the phone to call the police?

Yet another worthless ex-con walking the streets instead of in Hell where he belongs.

We should be executing a thousand times as many criminals as we do now. Basically any serious violent felony on the first offense, any violent felony on the second offense, and any felony on the third offense. But with a lot fewer things defined as felonies.

I think the texts were sent from a computer in his truck, not from a cell phone. I don’t know if he had a cell phone on him or if he was even able to talk with those injuries.

I suspect the cause of your confusion is the words “text message” and most everyone’s mind turning to a cell phone.

I suspect what really happened was the text messages where sent from a terminal in the truck that has no voice capabilities.

Think yahoo messenger, AOL messenger, IRC type text messages.

Folks, unless you’re armed, or you’re equipped to defend yourself in that situation, handing over the wallet may be the best thing.

Unfortunately it’ll take a long time to try this thug. Then if he’s sentenced to death, it’ll take fifteen years. Sometimes I think you do have to break some eggs to make an omelet.

The ones inclined to use a crowbar on you if you don’t hand it over are the same ilk who after getting your wallet will go ahead and use it on you anyway - to make sure you won’t follow them. Or just because there wasn’t enough in it.

News flash: A lot of those people have discovered that ‘dead men tell no tales’ - or in a more current argot, ‘dem stiffs don’ squeal, yo.’

Also, keep in mind that a ‘third strike’ for a repeat offender is the same sentence for murder in many states. This means that a habitual criminal has NOTHING to lose by killing any potential witnesses.

Not sure about that. Maybe he called police first?

I used to work in a similar job. Many communications utility locations where technicians work are out of the way and don’t have easily associated street addresses. It could make it very hard for police to find him, but other technicians and hopefully his dispatch would have a better time of it.

I have heard stories of technicians having heart attacks and calling their dispatch. I think that the tech might hope that dispatchers would be able to better help police/emergency services find them, especially if they are losing consciousness.

It must be awful to be the person on the other end of the line knowing that the person who called you is dying.

My sympathies for his family and co-workers.

Actually, I am simply pointing out that once they have already gone ahead and decided to commit their third felony (armed robbery) it doesn’t ‘cost’ them any more to go for murder. In fact, it’s desirable as the victim would be unable to testify and aid the police in apprehending the felon, and the three time loser doesn’t have anything to lose (remember, his third strike was the robbery, so he’s already done.)

You are correct, but so am I: I am saying that knowing that it would be their “third strike” can influence them not to go ahead and decide to commit it.

Once they’re committed, sure.

You and I are both assuming, though, that a criminal thinks things through. Frankly, most of them are stupid. It is stupid to live a life of violent crime. So I don’t know how much reasoning there is going on. Crime does NOT pay.

I as a potential victim feel quite assured that by the time someone commits their third felony, they are habitual criminals and have forfeited their right to live among those of us who are not. Three felonies allows for youthful mistakes, wrongful convictions, and rehabilitation.

By the time you are arrested, tried and convicted for three felonies, you have probably committed 300.
