I am posting this message from the Obama campaign (from August) after I saw a post on Facebook inviting people to join an Obama phonebank at the public library in Zionsville, IN tomorrow night. Is this a legal use of a public library? Can you use a publicly funded building to create a campaign headquarters?

I’m not sure. When I tried to host Concerned Women for America a couple decades back, I was told no political party stuff.

The good news was that this guy was begging people to come help him and was upset because no one wanted to go. I was curious as to the laws on this, and what it means to those patrons who don’t want to have to listen to an Obama phonebank

They use churches, temples and mosques on a regular basis, and make calls out of the White House, so what’s a public library to them?

It is legal to use the Public Library for meetings.

This is all I could find:
IC 36-12-7-3
Use of local library; fees; fines
Sec. 3. (a) The residents or real property taxpayers of the library district taxed for the support of the library may use the facilities and services of the public library without charge for library or related purposes. However, the library board may:
(1) fix and collect fees and rental charges; and
(2) assess fines, penalties, and damages for the:
(A) loss of;
(B) injury to; or
(C) failure to return;
any library property or material.

I don’t know how training partisan campaign workers qualifies as a “library or related purposes.”
Call your township trustee and if s/he can’t help you, contact your county commissioners’ office.

If Romney gets elected it will be darn near IMPOSSIBLE to ‘raise the bar’.. 0bama has not only lowered the bar, he’s buried it on so many fronts. I don’t think America will recover from wrecking ball 0bama. He’s not only destroyed us financially, but ethically as well. And Boehner and Co. just sit there, afraid of facing the race card the White House waves in front of them.

We tried to hold a Republican Committee Meeting in a Public Library room that they allow groups to use. It had nothing to do with any election, just a monthly meeting a few years back. I can’t remember why our normal meeting place was unavailable, but the Librarian, a Republican herself, said “Sorry, I just can’t do it.” This in NY. I don’t know if there was any law, but this library was fully funded by the city, and the Mayor was a rabid Democrat.

In Virginia with the library I use, it is okay to use it for a political activity. However, no one can be excluded from the room or rooms being used - that is it must be open to all Citizens that may want to attend since it is a public library.

It is probably legal for a library to have campaign activity, as long as it is 'demoRats. The ONLY thing that must Not can't never do: give out Constitutions at a library. Now, that is right OUT!

many libraries have meeting space that groups can reserve, groups like NAMBLA anyway.... the Jehovah’s WItnesses would be booted though.

Maybe the laws vary by state or by county.

I’ve attended Tea Party meetings in a library in a very liberal leaning county.

IMO, as long as the facility is made available on an equal basis, it’s fine. Ban them all, or allow them all.

So for those who have posted here about not being allowed to meet, it would be interesting to find out which groups were allowed at that particular library.
