Queens teacher suing city claiming he was beaten up by a first-grader

‘Tiny terror,’ 6, unleashes wrath at school

A hulking Queens gym teacher and former college football player claims a pupil fractured his ankle, injured his knee and forced him to go to a shrink for stress — even though the kid was only 50 pounds and in first grade.

Burly, 220-pound PS 330 teacher John Webster, 27, said a 4-foot-2 Rodrigo Carpio, 6, also kicked and pinched the Elmhurst school’s principal, a security officer and another teacher during a rampage in April.

“It’s sort of like an angel-devil sort of thing,” said the 5-foot-10 Webster, who recently filed a notice of his intent to sue the city and says he must now wear braces on his right ankle and knee.

“[Rodrigo] looks like an angel, but then, all of a sudden, that halo turns into horns. It’s been a nightmare. It’s embarrassing. It’s humiliating.”

But Rodrigo’s dad, Jorge Carpio, 44, scoffed: “The lawsuit is totally absurd. How could my little boy do so much damage? My poor son.”

The boy’s mom added, “This is a terrible thing to say [about] a child.”

“To every mother, their child is an angel,” said Josefa Marcia da Silva, 33, of her son, now 4-foot-3 and 64 pounds. “I know that he has problems, but he doesn’t deserve to be called such names.”

But Webster’s claims are backed up by an April 26 school “occurrence report” filed by the principal that says Rodrigo “was physically aggressive” and karate-kicked Webster in the knee and ankle that day.

Webster was accompanying Rodrigo and other students to the cafeteria for lunch when the boy started horseplaying, the teacher told The Post.

Not funny at all. Before we start accusing the guy of going for the deep pockets - I saw a 6-year-old send my 50-year-old friend to the hospital for hernia surgery in a very similar incident. You don't think they can hurt you, but they can hurt you. Could a 50-lb kid pop a 220-lb guy's knee? You better believe he can. Easily, and if you don't think so, ask a karate instructor what he teaches kids to do.

And before we start saying, "He's a big guy, he should have handled the thing," recall that if he'd swatted the kid or even grabbed him, he'd be in jail. If the Docs say his injury is real, he's got a case. IMHO, of course.

Somebody thinks the brat spawn is cute for acting that that way, look at the picture they chose to publish of him. Don’t know if family or media is to blame but at least one of them is. That is ridiculous-awww look at the cute little little future gangbanger.

You took the words right out of my mouth. I have several school teachers in my family, and all of them have seen a teacher in that situation, or have been close to it themselves. I even know of a case where a teacher intervened to stop one kid from hurting another kid (as in slamming another kid’s face against a row of lockers) and HE was the one who was in the most trouble. It’s insanity.

Yup, you are exactly correct. You can be the biggest, baddest dude (or dudette) on the planet. Your knee joints and ankles are still vulnerable, and can be wrecked with surprisingly little effort.

When I went for my final score, that’s when I saw the hook.

Anyways ... I did score 25 ... that is I can take on 25 five-year-olds in a fight.

Having worked in schools....I understand what you are saying.

This man would have been arrested and fired had he laid a hand on this kid....even if it was in self-defense. And, just read the parents comments....their “honey Boo Boo” isn’t all that violent....

The ones calling this teacher a “wimp” and a “wuss”...I guarantee you they are the same ones who would raise a violent kid like this....and sue the school if a teacher defended themselves from the kid. Guaranteed

The kid should’ve been expelled from the school. But maybe a public school cannot kick out a student so easily. Well, maybe this teacher suing the city will help to change that policy.

I concur. Some districts have implemented strict “no-touch” policies. Teachers are not allowed to even touch a child to break up a fight.

The same would be policy if a child were to go ballistic. Where I use to teach- a kindergartener tore up a room, gave some significant bruises to a teacher (female), the nearly took the woman principal’s head off - and this at a school where there is not such a strict hands-off policy. It took 5 adults to restrain the child. Even then- the child was extremely violent and uncooperative. Police came- and even they were flabbergasted by the child...
