We have some breaking news out of New York: The U.S. Court of Appeals for the Second Circuit has ruled on Windsor v. the United States, a case challenging Section 3 of the Defense of Marriage Act, and found a federal definition of marriage as one man and one woman violates the U.S. Constitution.

"[W]e conclude that Section 3 of the Defense of Marriage Act violates equal protection and is therefore unconstitutional," they wrote.

Our legal eagle Ari Ezra Waldman will have a full analysis soon.

Are you kidding me? Well, if we are going to redefine marriage, then I think we should redefine family as well. I think pets should be considered "Family". Think about it. To not call a pet a member of a family is a crime and unconstitutional. Plus I can always use an extra one or two dependents. ;-)

This is the kind of bovine excrement I’d expect out of the Ninth Circus, not the Second!

The barbarians in the Just-us Dept. and the White Hut have already said that they won’t defend the DOMA, so no worries about spending any money to defend it.

who wrote the Constitution had no idea what it required.

When drafting the constitution, our forefathers would have to have dug deep into their imaginations to cover the morals and ethics of today’s society. They would have never conceived of such as state of affairs. They came before gay pride and the ACLU.

> Want to make this a 48-state win for Romney? Bring up gay
> marriage.

Gay marriage was instituted in Massachusetts by the Mass. Supreme Court while Romney was governor.

The people responded with a referendum to define marriage.

The politicians on Beacon Hill would not allow the referendum to come to a vote in the Mass Senate.

Don’t know what Romeny could have done, but he did nothing.

The legacy we leave behind for our children, grandchildren and this great nation is crucial. As I approach my 94th birthday, I realize this election could be my last. I believe it is vitally important that we cast our ballots for candidates who base their decisions on biblical principles and support the nation of Israel. I urge you to vote for those who protect the sanctity of life and support the biblical definition of marriage between a man and a woman. Vote for biblical values this November 6, and pray with me that America will remain one nation under God.

Gay rights prevails because its central theorem - f*** who you want, when where and how you want, laws rules and customs nonwithstanding - has proven quite popular with the heterosexual 99%.

I know that it doesn’t violate equal protection, because I know that the Founders would never have intended this.

However, short of an amendment to the constitution, the truth will only be shown after the culture suffers the depths of depravity to which this will take us.

IOW, sadly, the only textual argument that can be made by our side is a convoluted one. It must go to either states’ rights or to a willingness to hear an original intent from silence argument.

The DOMA needs to be made non-reviewable, the Constitution needs to change, and short of that this will not be overturned with John Roberts and Anthony Kennedy on the bench.

Stupid judges.

oh the Bible is unconstitutional?

I thought our country was formulated on Judeo-Christian principles and the the Bill of Rights and Constitution were inspired by God. Let me rethink that. Yep. That is still what I think is true.

The culture is rotten and the courts are corrupt and rewriting the Constitution and laws.

We are done as a nation, but we can try to bring it back.
