We have some breaking news out of New York: The U.S. Court of Appeals for the Second Circuit has ruled on Windsor v. the United States, a case challenging Section 3 of the Defense of Marriage Act, and found a federal definition of marriage as one man and one woman violates the U.S. Constitution.
"[W]e conclude that Section 3 of the Defense of Marriage Act violates equal protection and is therefore unconstitutional," they wrote.
Our legal eagle Ari Ezra Waldman will have a full analysis soon.

Not this shit again...
Excellent. I don’t mind this getting wrapped into the campaign. Not at all.
Amazing how those people who wrote the Constitution had no idea what it required.
Well, back to the trees, and line up them females in heat, eh ~ gotta' start this over.
God created Adam & Eve, not Adam and Steve.
No doubt this is what John Adams had in mind.
It's obvious that the "intellects" on the Second Circuit have neither knowledge of the Constitution or biology. This is an outrage to "We the People".
Amen. Want to make this a 48-state win for Romney? Bring up gay marriage.
The Second Circuit Court.
I have a (liberal) lawyer friend whose favorite expression is that we’re a nation of laws, not men. But that is BS given the phenomenon of judges continually deciding that laws which were constitutional are now (magically) not constitutional anymore.
Did you make that up?
Why can’t we sick these people on something worth repealing like ObummerCare!
Sorry about that!
What a surprise.
“God created Adam & Eve, not Adam and Steve.
Did you make that up?”
Me thinks the vote toll is being considered by the Lord!
Those that vote Democrat in any way shape or form, are spitting on Him
47% of Americans do not pay taxes. I pay mine. Is that equal?
Friggin libral Judges.
Don’t anyone try to feed me this horse dung about 1% being homosexual. It just aint so,no 1% could change the morals and traditions of 3,000 years.
This is the kind of bovine excrement I’d expect out of the Ninth Circus, not the Second!
“God created Adam & Eve, not Adam and Steve.”
Bahahaha! Post of the Day! I am so stealing that! ...and a new tagline is born!
> Now, even more will be spent defending it, thanks to the
The barbarians in the Just-us Dept. and the White Hut have already said that they won’t defend the DOMA, so no worries about spending any money to defend it.
Sorry about that!
It’s allright. I just wanted to give a heads up to other posters. I should have figured it out by the name “towleroad”. LOL!
who wrote the Constitution had no idea what it required.
When drafting the constitution, our forefathers would have to have dug deep into their imaginations to cover the morals and ethics of today’s society. They would have never conceived of such as state of affairs. They came before gay pride and the ACLU.
> Want to make this a 48-state win for Romney? Bring up gay
Gay marriage was instituted in Massachusetts by the Mass. Supreme Court while Romney was governor.
The people responded with a referendum to define marriage.
The politicians on Beacon Hill would not allow the referendum to come to a vote in the Mass Senate.
Don’t know what Romeny could have done, but he did nothing.
The legacy we leave behind for our children, grandchildren and this great nation is crucial. As I approach my 94th birthday, I realize this election could be my last. I believe it is vitally important that we cast our ballots for candidates who base their decisions on biblical principles and support the nation of Israel. I urge you to vote for those who protect the sanctity of life and support the biblical definition of marriage between a man and a woman. Vote for biblical values this November 6, and pray with me that America will remain one nation under God.
Here’s a family-friendly link from the Wall street Journal.
“Dont anyone try to feed me this horse dung about 1% being homosexual. It just aint so,no 1% could change the morals and traditions of 3,000 years.”
Gay rights prevails because its central theorem - f*** who you want, when where and how you want, laws rules and customs nonwithstanding - has proven quite popular with the heterosexual 99%.
I know that it doesn’t violate equal protection, because I know that the Founders would never have intended this.
However, short of an amendment to the constitution, the truth will only be shown after the culture suffers the depths of depravity to which this will take us.
IOW, sadly, the only textual argument that can be made by our side is a convoluted one. It must go to either states’ rights or to a willingness to hear an original intent from silence argument.
The DOMA needs to be made non-reviewable, the Constitution needs to change, and short of that this will not be overturned with John Roberts and Anthony Kennedy on the bench.
” and found a federal definition of marriage as one man and one woman violates the U.S. Constitution.”
So anyone can marry any number of anything?
oh the Bible is unconstitutional?
I thought our country was formulated on Judeo-Christian principles and the the Bill of Rights and Constitution were inspired by God. Let me rethink that. Yep. That is still what I think is true.
The culture is rotten and the courts are corrupt and rewriting the Constitution and laws.
We are done as a nation, but we can try to bring it back.
Another abuse of the original intent of the Fourteenth Amendment. Who are these jackass judges?
Thank you. The WSJ is a tad more family friendly!
We should start out by building a list of their females to see if any of them are suitable for our anthro-harem purposes. If judges can so easily dismiss the current bio-based sexual pairing system then they can easily accept the reinstatement of the earlier system ~ and their own spawn should be brought into the practice as soon as possible.
These activist judges need to be recalled.
Whatever Romney wanted to do, the fact is this will come to one of two conclusions. Either the USSC will affirm DOMA or it will be made into an Amendment. When you have a majority of Californians voting for this, it’s not a contest.
Imagine the size of the koi pond Bill Gates would need to reduce his tax liability to zero.
No one really knows if 47% don’t pay taxes ~ since even new born babies get tagged with taxes it would be hard to slip that noose.
And who will they vote for? A guy from a polygamous background, or another guy from a polygamous background?
Another chance to take a roll call of the liberal SCOTUS justices coming up!
Romney instituted gay marriage in MA ~ that’s what he did. Starts with him.
Isn’t it obvious that if mankind truly “evolved” from random mutations that somehow exquisitely perfected us into what we are, homosexuality would long ago have been culled out of the human genome?
