Trayvon Martin's parents decry school records request

SANFORD – Hours before George Zimmerman will return to court for a hearing on his request for Trayvon Martin's school records, the teen's parents accused Zimmerman of needlessly attacking their slain son's character.

"I feel that Trayvon's school records are not relevant in this case," Trayvon's father Tracy Martin said this morning, adding that Zimmerman's medical records, also a pending issue for today's hearing, "are very relevant in the case."

"It is wrong to subpoena his records on so many levels," said Martin family attorney Benjamin Crump, who called the defense request "the old classic method of attacking the victim."

Trayvon's parents should blame Obama if the kid's school records are allowed as character evidence. After all, blacks recently polled said they felt less empowered since he was elected.

What is it? Blacks went through the strife and trouble with civil rights to get the right to attend schools, but none of them want their school records released.

If they had nothing to hide, they would show them voluntarily.

Cry me a river. Trayvon's "character" is at the heart of this issue and the school records will support the fact that he was a thug and a troublemaker.

Those are the "character" issues mommy and daddy want to hide because they have managed to get the media to treat this as a race issue with Zimmerman as the racist-in-chief.

Sorry mom and dad - you're about to be smacked in the face with reality, and Trayvon will be revealed for the thug-wanna-be that he was. To date, all of the prosecution's findings support Zimmerman's version of the truth. But, the case is being handled by a witch so they have to continue with the witch hunt!!

State lost on keeping DeeDee’s material away from subpoena too. State (de la Rionda) said that it hadn’t been proven that DeeDee was a minor, O’Mara said it is the state’s position that DeeDee’s ID had to be protected because she is a minor. LOL.

I think the defense already has witness addresses. The only issue is whether or not (or when) the public will get them. I was away about a minute after I posted that live link, so don't know what happened after the "is DeeDee a minor?" exchange instigated by de la Rionda.

The next issue is a request by West for the state to reveal to the defense the physical address of DeeDee, Fulton and Martin's brother. Instead, Nelson orederd the state to produce the witness for deposition and that the defense can ask their address at that time. West was not happy.

Citing prior case law, the judge in the George Zimmerman murder case on Friday ruled that the defense was entitled to the school records of Trayvon Martin and can also subpoena his social media posts.

In a self-defense claim, the defendant is entitled to inquire about the victim’s propensity for violence. As of now, the information will not be made public, Judge Debra S. Nelson said. But, if it is used in future proceedings, including any trial, it could then become public.

Zimmerman’s attorney, former Local 6 legal analyst Mark O’Mara, said online videos exist of Martin being involved in mixed martial arts-style fights. Nelson ruled that O’Mara can subpoena Martin’s Facebook and Twitter accounts.

O’Mara was also granted the ability to subpoena the social media posts of Martin’s girlfriend, who was on the phone with Martin when he was shot, according to his parents’ attorney. O’Mara said he believes her online postings may contradict her story.

Nelson said she would rule at a later date on O’Mara’s request to obtain FBI and Florida Department of Law Enforcement reports on the investigations into Martin’s death.

Nelson also said the defense team can ask witnesses their addresses during depositions. If they refuse, Nelson said she would intervene. The state argued that the addresses should not be disclosed for safety reasons.

During the hearing, O’Mara handed Nelson an emergency motion concerning a witness deposition that occurred on Thursday. Details about the motion were vague, and Nelson ruled that the matter would be addressed at a hearing next Friday.

MOM filed an emergency motion to sequster witnesses before deposition. Apparently a witness suggested some funny business.

I'm guessing that the prosecutor has been contacting witnesses before deposition, and O'Mara wants that to stop.

The defense is trying to tie down just who exactly Dee Dee is or whether she is two or three different people.

Same with Martin's brother -- he goes by two last names [Martin and Fulton] depending upon who he is talking to.

Well, the defense may wonder if the social media material it got from cached internet sources is DeeDee or not, but whoever gave the phone interview to Crump and to de la Rionda is just one person, as far as I know. If that ends up being two different people, the prosecution has a real problem.

Emergency Motion for Protective Order - 19 October 2012.

O'Mara says that it appears the state withheld exculpatory evidence, in particular, the consensus of the SPD that there was insufficient evidence to charge a crime, any crime. O'Mara wants this specific area of inquiry (SPD consensus) to be "off limits" as a discussion matter between the witnesses and any lawyers, until O'Mara has an opportunity to depose all of the SPD personnel and others involved in the meetings discussing the case.
