While Jimmy Terry fights for his life at a hospital in Modesto, his uncle Robert will not be charged with felony assault, as the District Attorneys Office deemed he acted in self-defense when he shot his nephew in the stomach from 15 feet away Sunday.
Sheriffs investigators are aware Jimmy Blake Terry, 25, suffered significant injuries and is expected to have an extended stay in the hospital, Calaveras County sheriffs Sgt. Chris Hewitt said, adding the hospital has not released any further information.
According to sheriffs reports, Terry, who is wanted for parole violations, confronted his uncle Robert at a home on the 1800 block of Rawhide Road in Arnold Sunday morning and the two started arguing about Terrys suspicion his uncle was ratting him out for crimes committed in the area.

It is a bad thing to be forced to shoot a relative in self-defense;it is a worse thing to die because you didn’t.
You've got that right. Absolutely right.

Reminds me of a TV series I used to watch... Actor named Jon Hexum was farting around on the set with a stage pistol loaded with blanks and put it up to his head and pulled the trigger.....killed him.
I watched the series then because of Jennifer O’Neil who I thought was hot.
Sounds like an upstanding citizen./s
(BTW, link doesn't work.)
Lesson learned: guy with shotgun is not impressed when you start flexing your muscles and giving him the Billy-badass routine.
Horrific results from just a powder charge.
Ban salt now!! We need reasonable, modest, common-sense restrictions on salt shaker capacities, granule size “caliber” and the total “arsenal” of how many ounces of salt anyone can have at one time. Salt is only used one shake at a time, who needs a whole pound, except someone bent on, that’s right, you’ve got it - assault!
I was 14 at the time and this Jon-Erik Hexum death was specifically used by my parents to illustrate to me why you don’t go messing around with guns for any reason. Loaded with blanks or unloaded or anything, it doesn’t matter. Any friend of yours that does is an idiot and nobody you should be hanging out with.
My parents were just starting to let me go to the rifle range by myself. (Back then in Wyoming, riding my bike 2 miles to the range with my .22 rifle slung over my shoulder and ammo in my backpack would not get me thrown on the ground, kicked around in the dirt, and arrested for a wide range of terroristic charges, but I digress...)
Ban salt weapons.
Holy smokes, I was just on Rawhide Rd. a couple of days ago on my way to Angels Camp.
Kewl; thanks.
If you cant get the link to work, like me, try this one.

The blast from the powder blast alone from a shotgun close up would easily blow a guy's skull open. Saw a picture of it somewhere.
I suspect that much better results from rock salt would be obtained by using the ‘miner’s trick’, of creating a solid plug of paraffin and rock salt. This keeps the rock salt together, reducing dispersion, and the greater mass gives better momentum.
Here’s an article about three deaths from blanks.
Co-star, Jennifer O'Neil, [an anti-gunner] had a run-in with a gun at the home of her boyfriend sometime later on. The boyfriend was an ex-felon and could not legally posses a gun, yet O'Neil found the loaded .38 revolver on a coffee table. Somehow, she managed to shoot herself in the stomach while supposedly unloading it. Right! No charges were filed, the shooting was considered accidental, and O'Neil recovered. Jennifer brought new meaning to “taking one for the team”.
I remember reading about it in an article that was "pro-organ-donor-cards." IIRC, Hexum's organ donations saved a number of lives, and restored sight to at least one person.
It was sad to hear what happened, but his willingness to donate his organs was at least a silver lining around that horribly dark cloud.
