West seeks hearing after Murphy camp declares victory when St. Lucie board misses noon deadline

The St. Lucie County canvassing board has missed a noon deadline to file election results to the Division of Elections, prompting campaign officials for Patrick Murphy to declare the political newcomer the winner in the race for congressional District 18 race.

Under Florida law, the final certified results were due from all of the state’s 67 supervisors of elections today. If the results do not arrive on time, the certified unofficial results submitted last Sunday stand. Those results have Murphy winning by 0.58 percent. A spread of less than 0.5 percent would have triggered an automatic recount.

“Today at noon, it became clear Patrick Murphy will be officially certified as the next congressman from the 18th Congressional District,” Anthony Kusich, Murphy for Congressman campaign manager, said in a prepared statement issued around 12:40 p.m. “The voters have spoken and Patrick Murphy is once again the clear winner. It is beyond time to put this campaign behind us and put the interests of the people of the Treasure Coast and Palm Beaches first.”

Tim Edson, Murphy’s campaign manager, disagreed.

“As usual, Murphy’s people are full of garbage,” Edson said. “This is something the secretary of state and governor will have to sort out.”

Edson said other problems arose this morning. The recount showed 900 voters cast ballots in precinct 93, where there are 7 registered voters, Edson said.

“We have concerns here,” Edson said. “The results are raising more questions.”

Shortly after the deadline passed, attorneys for West headed to the St. Lucie County Courthouse to request an emergency hearing on the issue. It is not known if a hearing has been scheduled.

This is why we recount. You can't certify this result. Now he's got Constitutional issues to preserve and can get it out of kangaroo, er, Florida courts.

At this point anything they come up with is highly suspect.

Their refusal to certify them is what is highly suspect.

They need to certify what they have recounted so that we can see them and compare to the original numbers.

They need to certify them -- deadline or not.

Bev Harris of Black Box Voting did the last two, and they show that the memory cards containing the totals from the scanners are easily rigged by a competent programmer - Democrat OR Republican!

Without a full recount with *clean* machines West will still lose. We are screwed!

Ms. Walker’s own statements about double counting some ballots and not counting others leave this race certifiable. How can one certify something that is a mess? Certifying by her own count a race with “mistakes made by her and her people”, makes a mockery of “certification”. IMHO, then “certifying” that those votes are TRUE and to the best of her knowledge Correct, isn’t TRUE at all?

First off, I’m not being snarky.

Have you contemplated seeing a therapist? While I don’t know you personally, your posts here could quickly lead one to vote you most likely to leave a suicide note in the near future. You are obviously very depressed. Buck up camper, Romney lost but the world is not coming to and end.

Also urge all you friends and relatives to not spend one dime in the State of Florida on vacations. There are other states that hold honest elections where your money will be better spent. My wife and I spent several thousand dollars this year on vacation in that rathole. We have done this for the last decade but will never do it again. Maybe Texas or South Carolina if we want to go to the beach or even our own Alabama Gulf Coast.

Palm Beach Gardens, Fla. – The Murphy for Congress campaign released the following statement regarding the mandated noon certification of the 18th Congressional race by the county canvassing boards:

“Today at noon, it became clear Patrick Murphy will be officially certified as the next Congressman from the 18th Congressional District,” said Murphy for Congressman campaign manager Anthony Kusich. “The voters have spoken and Patrick Murphy is once again the clear winner. It is beyond time to put this campaign behind us and put the interests of the people of the Treasure Coast and Palm Beaches first.”

Florida law is very clear that Murphy’s win will now be certified. The law specifically states: “If the returns are not received by the department by the time specified, such returns shall be ignored and the results on file at that time shall be certified by the department.”

We expect the Department of State to thus certify the election and confirm what the voters of the 18th District have said loudly and clearly.

I’m not depressed, though I am sad. I can’t help but to be sad because I have seen the country that I grew up in die before my eyes. I have seen a country of free people vote their freedom away, while other people in the world who have no freedom stand in line to vote even though their enemies hack them to death with machetes while they do so.

But my emotion is not relevent to the current situation here in America. I believe that we have no hope of successfully addressing this until we accurately frame the circumstances of our problem and how we got here.

Let’s just say for the sake of argument that next election we fix this by voting in a bunch of republicans. That will fix nothing for two reaons. First the enemy will simply reshape itself and continue with its systematic plan until the opportunity arises for it to implement more of it in permanent fashion. They are patient, peristent and highly motivated.

Secondly, the republican party stands for not a damn thing. It does not even stand for its own election. I’ve never seen anything like this. I mean it’s like they suffer from battered wife syndrome or something.

As far as I know, there is essentially only one way to “win” a game of chess in which your opponent has already placed you in checkmate.

I think West is a MAN...this recount was to see if an official total recount of all the voters in his district would be mandated by law...

so now...if he wants a recount, he'll have to pay for it....which means US...

I am unclear whether that botched card was ever included in the count...seems like all morning they kept saying it'll be one very soon, and just before the deadline, they had problems...

I'm not giving up...

everyone says Romney should have questioned all the votes by this past rigged election...well, you can see how much effort that rats put into this one district....how can you fight fraud in thousands of districts...

UPDATE: Final tally is in. Murphy wins

UPDATE:

The official word came in about 2 O'clock Sunday afternoon that Patrick Murphy is the clear winner. Officials at the St Lucie County canvassing board counted more than 37-thousand early votes, write in candidates ballots and provisional ballots. The final total for all 8 days of early voting showed Allen West getting nearly 53 thousand votes and Patrick Murphy received nearly 66 thousand votes. In the recount, West gained 32 votes and Murphy gained 274 votes. Murphy's team team says this proves that he is the clear winner in the congressional race and that it is time for West to concede. West's team says they will go over the data from the recount to make sure that everything was done correctly. After that they will decide what their next step will be.
