The Supreme Court on Monday ordered the Fourth Circuit Court of Appeals to examine the constitutionality of the health reform laws employer requirements and mandatory coverage of contraceptives without a co-pay.
The move could open the door for President Barack Obamas health law to be back in front of the Supreme Court late next year.
The Supreme Court responded to a request from Liberty University, one of the groups that sued over the health care laws individual mandate in 2010. When the court ruled in June that the mandate was constitutional, it dismissed Libertys entire lawsuit.
Over the summer, the school asked the Supreme Court to reopen its arguments against the employer mandate and the contraceptive coverage mandate, which it said were not addressed by the court's ruling this summer. The court on Monday agreed to the request and told the Fourth Circuit to hear arguments on the two pieces.
The Fourth Circuit, which traditionally moves quickly, could hear oral arguments in the case next spring.
The school's lawyers have told POLITICO that they hope to eventually bring the suit back before the Supreme Court.

Meh. It’s an important issue but a narrow one. In fact, SCOTUS may not even hear any appeal from the 4th Circuit Decision.
At least it’s not “bad” news.

What a joke. The Supreme Court and its Justices are a bunch of political hacks that can’t read and interpret the English language. They vote one way or another so they feel good about themselves.
Not necessarily. Roberts is a very catholic guy. His bishop was very much against obamacare on the grounds that it abridge religious liberty.
That’s why the Scotus ordered the appelite court to review the matter again.
I’m guessing that CJ Roberts, whom you describe as a very Catholic guy, wasn’t too worried about either his bishop or his catholicism when he went to great lengths to twist and turn logic and the law on its head earlier this year by being the deciding vote to declare ZeroCare legal.
