Boy, 12, Convicted in Murder of Neo-Nazi Father

A judge found true on Monday that a 12-year-old boy committed second-degree murder when he shot and killed his white supremacist father.

32-year-old Jeff Hall, a regional leader of the National Socialist Movement, was shot at point-blank range with a .357 Magnum while he slept on the couch in May 2011.

His son, who was 10 at the time, confessed to the murder on videotape.

Prosecutors argued that the boy shot his father to keep him from leaving his step-mother.

They said that the boy’s violent tendencies went back to kindergarten, when he stabbed a teacher with a pencil.

The prosecution’s case was bolstered by the boy’s younger sister, who testified that he told her he was planning to shoot Hall days in advance.

The defense maintained that the boy grew up in an emotionally and physically abusive environment, where he learned that violence and killing were acceptable.

Riverside Superior Court Judge Jean Leonard had to determine whether the boy knew what he was doing and if it was premeditated.

In juvenile court, there is not a “guilty” or “not guilty,” but instead findings of “true” or “not true.”

In issuing her finding in the case, Leonard acknowledged the boy’s history of abuse and neglect, but said, “This was not a naive boy.”

Leonard said that the child “knew what he was doing was wrong at the time of the crime,” citing statements he made in the first 24 hours after the shooting, before getting an attorney.

Sentencing in the case is scheduled for February 15. The boy, who was tried as a juvenile, faces up to 11 years in juvenile detention. His attorney says he plans to appeal.

The crime occurred when he was 10, most likely he will serve his time in juvenile detention until he is 21. Upon his release his rage will be at its apex unless he gets a great amount of counseling while incarcerated.

Both father and son sound more like nuts than anything else. I hope the lad regains enough sanity to not be a menace when, as by law he must, he walks out an adult. Having done what he did, he might be reverenced by the lesser juvies, not an edifying position to be in.

Who knows what the place will be like. If it’s another feral male ganged, fatherless hell it will be a huge detriment to any hope he might have of emerging sane. But at the same time they won’t want to put the enraged youth with kids busted for trivial things like pot smoking.

The only real question for the court should be is the boy a psychopath, sociopath, or acting in what he thinks is self defense. This can be determined by examination.

A psychopath is a scale of people who are unable, more or less, to empathize with others. Everyone needs at least some ability to not empathize to function, but taken to an extreme, “human life means nothing to me” is true in a very real sense. They can harm or kill another person with utter indifference.

A sociopath is a scale of people who have been trained to ignore empathy with others, such training including dehumanization of their designated enemies, along with aggression training against them. If caught at a young age, sociopaths can be retrained away from antisocial behavior, but with some degree of maturity, it is unlikely they will change.

Self defense for a child is less objective, as they might fight back immediately when attacked, or when they see their attacker unprepared for attack, or even when they imagine an “existential” threat, real or fantasy. And while to adults this latter group may sound far fetched, to a child they can be a very real thing.

In any event, the child will have to be institutionalized, no matter what, if not in jail than in a psychiatric facility until there is some confidence about their condition and their response to that condition.

Here is a textbook case of an 8 year old boy who killed both his father and another man.

Read a bit about this--a TV crew filmed a meeting of the neo Nazi group at his house mere hours before, and the kid could be seen, etc. Dad got drunk, went to sleep on couch at mid. and the boy shot him about 4 a.m.

Speaking a 10 yr old murderers, a couple boys that age "abducted, tortured and murdered" a two year old, in England. (Irony: the victim's name was the same as a legendary US gangster: James Bulger. The latter nicknamed Whitey.) Recently I believe the boys, now in their twenties, had their names released. Mug shot of one of them at time of capture showed he was only 4 foot 7.5--rather slight but big enough to brutalize and kill a toddler.
