Did New York State Just Accidentally Outlaw ALL Firearms?

Did the New York state legislature just accidentally make it a crime to merely OWN a firearm?

See page 22 of the posted bill, s2230:

§ 41-a. The penal law is amended by adding a new section 265.01-b to 5 read as follows:
6 § 265.01-b Criminal possession of a firearm.
7 A person is guilty of criminal possession of a firearm when he or she:
8 (1) possesses any firearm or;
(2) lawfully possesses a firearm prior to
9 the effective date of the chapter of the laws of two thousand thirteen
10 which added this section subject to the registration requirements of
11 subdivision sixteen-a of section 400.00 of this chapter and knowingly
12 fails to register such firearm pursuant to such subdivision.
13 Criminal possession of a firearm is a class E felony.

Yuppers, NY just outlawed every firearm.
The language is purposefully conmvoluted except wher it sates that merely possessing a firearm is a crime, period.

I need some coffee.

Wow- take it easy fella- I was speakign of the federal government pushuign through sweeping nationl bans and intrusive gun laws on ALL states- no nered for you to get so upset about what I said- I’m simpyl readign the writing on the wall which is pretty obvious given the FACT that the left’s stated goal is to remove guns fro mthe hands of law abiding citizens and the FACT that the perez is threatening to do just what I described- not sure why you’re gettign upset about facts that are outside of my control and which ARE rearing their ugly head all across the nation?

I do not know how many of you are aware but NY is on the verge of becoming the first state to increase the laws/tighten the laws regarding firearms. Now, You may think that you don't have the firearms they are referring to, or you think you are not involved, but you are.

Every NY resident is affected by this new law. Crime WILL go up. YOU will be at an increased risk of becoming a victim. That is unacceptable.

Gun owner or not, you, as a NY resident are affected. All legal gun owners are potentially criminals now with the new law. The so called 'Assault Rifle' determination has changed to effectively include ALL AR-15 style rifles, which are used in sporting events, and for self defense. Even some hunting rifles or shotguns can be determined to be bad. The new 7 round magazine capacity limit is senseless and mere possession of one that contains more than 7 will be a Felony.

There are some issues with they way a mental health issue is reported and handled.

ANY ammunition sale will now be subject to a NICS check AND recorded. (BATF forbids such records)

Also, the way this new law was made violated a number of basic constitutional procedures and rights, not to mention the whole process of forming a law.

I urge you to do a few things.

First: read the actual text of the law. Educate yourself and know what it says.

Then, start informing everyone you know about this. Pass along the link to them as well. Be informed, have aplan of attack. Do it the right way so that you have an effect on this.

Successfully represented clients in the past on Second Amendment issues in NYS Supreme Court. This case is pro-bono for all the gun owners of New York. According to Mr. Tresmond the new ban is illegal as it is an ex-facto law taking away previously owned property and he intends to file this action in Federal Court.

Contact your state and local representative and talk to them about it. Some food for thought: they swore an oath to uphold the constitution of the United States and NY State. if they voted yes, they just violated that oath.

I hope you’re right Quickgun- but I’m sure many districts in countriesl iek Australia and europe said the same thing- righjt before their govenrment forced them to give up their rights- Orbsama is threateniong executive order (and cuomo BYPASSED any public hearings o nthe issue by orderign ‘emergency action’ due to ‘the seriousness of the gun problem we have in America’ which effectively meant that he got to ram this through without ANY opposition from groups liek hte NRA which woudl have made htep ublic aware of what the gov was abotu to do to them- and owudl have resulted in a lot more protests- and the gov didn’t wish to deal with thsoe pesky peopel called voters- because it might put a damper on his unconstitutional gun grab- nowe NY’ers I see have to go through as background check just to buy ammo- which means they’re now in a federal and state database as to how much ammo they buy, when, where, etc etc etc- handgun owners now have to register their gun every 5 years- apparently makign htem a criminal or law breaker if they don’t or if they forget to-

The FACT that htis bill just went htrough NY without ANY real opposition does not bode well for the future of gun owners across the coutnry- Sure, NY is a libeal state downstate, however, upstate is (or at least waS, last I knew) a conservative section of hte state- and I’m not seeign anyoen fro mthe conservative part even so much as vowing civil disobedience to the new law- perhaps soem will try- but my goodness- the NRA shoudl have organized a massive civil disobedience movement seeigns how NY’s governemnt has felt theycan disobey the constitution

The 2nd amendment clearly does not give Government the right to regulate any kind of fire arm. If you go down the road of reasoning that they are using then where does it stop? When there is one worthless gun left that is not illegal.

These laws are highly unconstitutional. But don’t expect the USSC to ever put a stop to it. They have been infiltrated by the same groups of people that are responsible for this. Including the chief Justice Roberts. The USSC is now a lawless body of which the states should put on ignore.

Sir, we are fighting back, see my post, #184 just previous to yours. There was no time to organize any protests prior to the illegal passage of this unconstitutional bill because Cuomo and his cronies violated state law and rushed the bill through, ignoring the 3 day public review period that's codified in NYS law. We're dealing with a tyrant here, Sir, and they ignore the law as well as the will of the people. We've got a class action lawsuit in the works (it's in the post that I linked) and we're going to exhaust all the legal channels. As far as advertising about an uprising/revolt, you do know better than to tip your hand about that sort of thing, don't you?

I know a lot of folks say the states will cave to pressure if funding was cut off, but that would be a win- win for us here in Texas,Cut our federal funding, we stop sending federal income tax. Cut off welfare checks to Texas? Whoop-Whoop, dare them. then our “receipients” would move. Stop social security? Texas can go it alone.We can generate enough revenue to take care of elderly until the state could implement some changes.
If we stopped sending any income tax to the feds, they couldn’t enforce that any more than they could confiscate guns.I think most states could do better without filtering most of the tax revenue through the wasteful fed gov. give them the percentage it takes to keep the military afloat, and a FEW salaries, and that’s it.

Rus. Looked into this for you. I do beleive Texas may be one of only a very few that might stand up to the govenrment- I certainly hope so any ways- please please, never elect a liberal with hte idea that they are looking out for you- we’ve seen what happens when states elect liberals because liberal promise them things- it aint perty

That is a trait that is very rare i nthis country these days- if SS were cut off in NY or Cali or any otherl iberal state- the state woudl say ‘tough @$@#$ if you don’t like it- you’re on your own”

I hjave proposed that very thing several days in a row now for NY’ers to do- STOP sendign the government their taxes, and we’ll see how long the govenrment holds onto their unconstitutional laws- Their governemnt is FAILING to do their job, and NY’ers shoudl either fire them or cut off their funding until they seek jobs elsewhere- because they sure as hell aren’t earnign their keep in NY by failing to protect the citizens’ constitutional rights- but sadly it appears that NY’ers hasve no spine- UI’ll be truly trulty chocked IF I see the citizens band together and tell the government htere how thigns are goign to be from here on out-

You are one New Yorker that I wouldn’t mind coming to Florida and staying.
The trouble we are having now are the ones we usually get are like the Burmese Pythons, not indigenous to our systems.
They gravitate to places where they morph into Condo and Homeowners Association Nazis. I usually quit listening at them when they pronounce “This the way we _____________________________________!
