The Smith & Wesson 9 mm handgun that Adam Zachs used to murder Peter Carone in West Hartford a quarter century ago is missing.
Zachs' new lawyer, Aaron J. Romano of Bloomfield, hopes the judge who will consider Zachs' habeas corpus claim will take note of the missing weapon as he or she considers whether the 60-year prison sentence Zachs is serving is proper.
Romano is seeking to overturn Zachs' 1988 conviction for murder. He is claiming that Zachs did not get the lawyer of his choice and that the trial attorney he ended up with was ineffective because, among other things, he failed to have the murder weapon examined by a firearms expert.

Well folks, where is the S&W 9 mm, used in this murder? Hmmmm? We don't have stats, that I could find, on how many confiscated weapons *disappear* from police evidence rooms....and *possibly* find their way into murders, suicides, etc.
This report is a classic.

Was the weapon available when the trial was held?
If so, case closed, as far as I’m concerned.

I don’t think this has much of a chance. The lawyer has no affirmative evidence that his trial or conviction was unfair or wrong, just speculation.
I must admit, I didn’t follow this trial when it was in progress. But I think Zachs is complaining that his first attorney, never had the pistol *tested* to see if it would misfire.. It’s clear Zachs, didn’t like the thought of prison....I have no idea if the shooting was accidental or not.
What peaks my interest is that this was a FP story, and it pretty must flies in the face of all the liberal propaganda the Left throws out every day, about who and what kind of guns *people* should own.
No. Those fools were so hell bent on “getting” me they completely failed in any forensic tests that could have proven my “guilt”. I could have just gone home and gone to bed.
Like I said before. I did 2 things wrong. Taking my eyes off that SOB. And trusting in “my fellow peers” to abide by the truth.

I agree, but that wasn’t my point in posting this article. The cops *lost* the gun. Meh.
All the preaching the Left does is going to get this instance repeated back to them, when that subject comes up. :)

The cops didn’t lose the gun, as records indicate it was signed out by the prosecutor, who has retired. The article noted that they have been unable to contact him yet.
Since they also noted that had he *not* signed it out, it would have been disposed of as a routine matter anyway after a given length of time, it really becomes a non-issue.
Unless the retired prosecutor can and does produce the actual gun, this appeal is over. Even if he does, and some “hired gun expert witness” claims it could have gone off accidentally, it *still* doesn’t matter.
Appeals are based on actual flaws in a case, not theoretical flaws discovered after the fact, unless they are certain to have contributed in such a way as to exonerate. That just isn’t the case here.
