FL:Man who held suspected hit-and-run driver at gunpoint describes that night

When John Avery II saw a pickup truck fleeing after hitting a pedestrian at a Jacksonville intersection Wednesday night, he wasn’t just going to let the motorist get away.

“I thought he had actually killed the guy.” Avery said Thursday. “I just felt there was no way in the world that he should be able to drive away from an accident where somebody died.”

Avery, 44, followed the truck to a nearby parking lot and used his gun to apprehend the driver, holding him until police arrived.

It used to be known as a plain vanilla citizens arrest. Now it’s piquing news.

Sounds like an excellent way to lose your CCW permit. Solving crimes is what armed cops are permitted to do - not armed citizens who just happen to be nearby and are not personally threatened. But since he didn’t pull the trigger, they might let it slide. Would totally depend on the attitude of the cop on the scene.

The driver, Tracy Andrew Isbell, 26, of Covington, Ga., was being held Thursday in the Duval County jail on an unrelated charge of armed possession of marijuana.
I want to know what armed possession of marijuana means? lol

Lots of crimes have enhancers if you do them while armed.

if you get into a fight wearing your gun you’ll be charged with several things, “while armed” -and it will make it significantly worse.

Two points. The first is if you are involved in an accident in a bad neighborhood, where you might be endangered if you stay around, you *might* be able to leave the scene, if, as soon as you are out of danger, you call the police and wait for them there. But absolutely zero hesitation is allowed, and the clock is ticking.

If you are pursued, you basically *have* to find a cop ASAP, because your pursuer could get a lot of leeway if they smite you or try to.

So the best bet is to remain on scene if at all possible. Watch out if a crowd forms.

CCW means you can have a gun ..BUT.. don’t use it..
If you use it they will take it away..

Pretty much like you RENTING your house from the givernment for property taxes..
The givernment REALLY OWNS your house AND the gun..

Not really. Every time anyone shoots someone, there is a risk that they will be found guilty of a crime and their gun taken away. If you have a CCW, you have removed the risk of the government saying that you were not allowed to have the gun concealed.

The default position is not to use the gun. Using it is a rare event that will likely be investigated to insure that it was justified.

This is as it should be.

He witnessed a crime, called the cops, and detained the perp for them, without firing a single shot.

Depends on where you are.. If you ride your Unicorn into some places you are not welcome if armed.. but the Unicorn is..

The police and firefighters are UNION.. almost universally in the US... with many being traitors behind the blue line.. and in some places MOST BEING traitors..
