I think so. Based on info in today's paper they lived above the shooter with a patio above his. They let the dog pee and crap on the patio and every now and then would sweep it off to the ground below, directly in front of his patio.

His solution was still unwarranted, but it sounds like he had reason to be upset.

The lady across the street, while "walking" her dog allowed it to relieve himself on my lawn. I put the poo in a nice box, wrapped it with gift paper with a ribbon, and next daym knocked on her door. She was so grateful and smiley when she accepted the gift box and was unwrapping it ... until she looked in the box.

For about five priceless seconds I watched her face slowly change to rage as she realized what it was and why I was giving it to her, and screamed at me as I hustled away, with me smiling.

Lessons:

(1) A creative and appropriate response to a disrespectful trespass brings awareness and subsequent responsible behavior.
(2) Later on, this lady treated me with respect and cordiality. (She even gave me a good reference in obtaining my CDW license application.)
(3) For over 25 years, no dog deposit ever showed up on my lawn. Neighborhood dog-walkers still tend to give my property a wide berth.
(4) Not long after, the neighbors voted me as president of the village association (102 properties). In my time all complaints of animal difficulties were dealt with quickly and effectively.

The story has apparently stuck around a long time.

This Texan took a very, very wrong approach over a dog. Nevertheless, people in that area might think twice about failing to control their pet's behavior, and the degree to which it offends others, perhaps irrationally.

Your "creative and appropriate response to a disrespectful trespass" could also have backfired, but at least it all worked out OK.

There's no excuse for shooting the neighbors but it sounds like he had to live with more than an "occasional" dog deposit.

And a lot of people think that they are under no obligation to minimize the causes of conflict with others. This is the entitlement mentality at work. Evidently, people are entitled to have pets and to impose the burden of those pets on their neighbors.

Convincing people that you are insane is sometimes a way to reduce conflict with them. Apparently this shooter was not successful in convincing his neighbors that he was murderously incapable of peacefully resolving this issue. There is no "win-win" for any of them.

There is now an opportunity for some other senile gun-owner to clip a copy of this article and anonymously deposit it in his neighbor's mailbox.

There is a lesson in this for all of us. When some people get to be 75, they just may value some things above life itself; that is, above the value of YOUR life.

Yep. Any response could have backfired. One needs to be prepared. I was.

Yep on that, too. Though the upstairs neighbors were not polite in an armed society, the shooting was not defensive of self or property, was way, way wrong, and gives the liberals a chance to bad-mouth 2nd Amdt believers.

(Chung Kim sounds Korean to me. No sense of ol' good-boy Texas humor. Couldn't think up a creative way of getting even without leaving five orphans. Guess his neighbor wasn't much in for 2nd Amdt defense of self, girl-friend, or her children, whose ever they were.)

Kim could have sued the landlord for failure to administer the lease agreement, and for relocation. I imagine it would be a trial for an old loner to live beneath a family with 5 kids. Put up with it, or move. Recognize that it's a free country, or leave.
