On the Senate floor moments ago, Sen. Mike Lee, R-Utah, reminded his colleagues that they still didnt have the full text of the gun control bill they were about to vote on.
Lee explained that the text of the background check compromise proposed by Sen. Pat Toomey, R-Pa., and Sen. Joe Manchin, D-W.Va., on Wednesday had still not been revealed.
As of this morning, as of this very moment, not a single senator has been provided with the legislative text of that very provision. Lee stated, reminding his colleagues that the provision was the heart of the bill.
If this thing passes on the basis of “I don’t know what it says but the Party is behind it so it’s OK” then we will, at last, have arrived at a dictatorship.
Our so-called legislative process has been hijacked and corrupted by secretive language, rushed schedules, and “gangs” of like-minded politicians instead of being conducted in an open and transparent process through hearings and votes. The Founding Fathers must be rolling over in their graves.
Well, we already know why the text is not available. They are hiding it and these azzholes are going to vote on it anyway.
After they pass it so we can see what is in it, and we find out the betrayal, they will cry foul. But it will be too late. The creeps think that will cover their treachery.

I think we’re already there. The Republicans are simply going through the motions to make it appear otherwise.
They’ve all been threatened and are compromised. They can make worthless noises but they’d better not cross the line. IMO
So, Senator Lee, are you going to call people out by their names and call them traitors? If not, I don’t wanta’ hear it.

Summary of Title I: This section improves background checks for firearms by strengthening the instant check system.
- Encourage states to provide all their available records to NICS by restricting federal funds to states who do not comply.
By "all their available records" just what records are they blackmailing states for with that statist bilge water? "All" is a pretty big word when only a very few records are applicable to denying someone their right to keep and bear arms.
- Allow dealers to voluntarily use the NICS database to run background checks on their prospective employees.
Does that means dealers can run NICS checks on prospective employees without their knowledge or consent? I have no idea what the word 'voluntarily' means there. Does it mean dealers will be allowed to not run NICS checks if they prefer not to?
- Clarifies that submissions of mental health records into the NICS system are not prohibited by federal privacy laws (HIPAA).
Submissions of mental health records? Since when has it been legal to deny any American their rights without due process? Isn't it required that a person be adjudicated mentally deficient by a court of law to do that? Mental health records are entirely irrelevant except to those court proceedings. This bill sounds like Stalinist purge material.
- Provides a legal process for a veteran to contest his/her placement in NICS when there is no basis for barring the right to own a firearm.
Is that an admission that the Bill of Rights doesn't cover veterans or an admission that it doesn't cover anyone anymore?
This bill is worse than any ban on some specific models or types of guns. It's a huge foot in the door to trash the 4th Amend., the 5th Amend. and the 10th Amend. as well as the 2nd Amend. Was all of this gun control demagoguery really just a Trojan Horse to sneak this Bill of Rights killer into law?

My view is there is conflicting language the will allow judges to determine what the law means. Considering how liberal many judges are, I see potentially bad news for those that hold the second amendment dear.
In particular there is a lot of confused language regarding transfers. (more on this later). I am certain that Toomey and his staff hoped that the following language would solve and bad language.
“...SEC. 129. RULE OF CONSTRUCTION.
Nothing in this subtitle, or an amendment made by this subtitle, shall be construed-
(1) to extend background check requirements to transfers other than those made at gun shows or on the curtilage thereof, or pursuant to an advertisement, posting, display, or other listing on the Internet or in a publication by the transferor of the intent of the transferor to transfer, or the transferee of the intent of the transferee to acquire, the firearm; or
(2) to extend background check requirements to temporary transfers for purposes including lawful hunting or sporting or to temporary possession of a firearm for purposes of examination or evaluation by a prospective transferee....”
One of the things that I find troubling is that firearms transported interstate must be unloaded and not accessible to to the driver. If a concealed carry holder has a valid license in two neighboring states, he should be allowed to carry while driving, but this federal law could trump state laws.
I am also concerned that the temporary transfer exemption for safety training, shooting competitions, hunting and trapping is really not well spelled out.
Another problem I see is the potential price of the transfer check. I don't trust the AG to be reasonable.
I will urge my legislators to oppose passage.
