WA:Suspect from Enumclaw intruder shooting arrested

In the incident Monday a man who returned home and found two intruders shot and killed one with a shotgun. The homeowner also fired at the second suspect as he fled in the stolen SUV, shooting out a window.

Folks, be careful with that second shot when they are running away, especially in a vehicle.

Not in Texas. Down here if one suspects that the burglar/robber has something of his then the ‘suspect’ is fair game.

I wasn’t born in Texas but I got here just as quickly as I could.

ME NOT READ ARTICLE >>> ME ALREADY KNOW ... they were talking about the second suspect was arrested... not the home owner.

Feel free to shot someone who you feel is an immediate danger to you or someone else.

Strongly resist the tempation for revenge or shooting at someone who is running away from you and that a jury would likely determine was not a deadly force threat at that point in time.

we have a local case where a guy drove off in a vehicle he stole and the owner came out and tried to shoot out the tires, but missed and shot the guy in the back of the head, killing him........no charges yet but even the talk of them makes my blood boil...

Sorry but under that circumstance, I'm not willing to put my future life in the hands of a jury........

This story raises an interesting point. I can imagine a lot of people would object to shooting a “property crime” felon as they were attempting to flee. But what if the fleeing felon had *also* committed an act of aggravated assault, possibly leading to homicide? Any problem with shooting the fleeing felon then?

The reason I suggest this scenario is that like in this case, when one of two *at least initially* “property crime felons” is legally gunned down by the homeowner.

Since when arrested, the other felon *can* be charged with aggravated assault, perhaps homicide, based on *your* shooting of the first one, by fleeing he is no longer just a “property crime” felon, but one you have “witnessed” being responsible for aggravated assault, possibly leading to a homicide (which you cannot legally determine, unless you are a medical doctor, even if you have ‘blown his head clean off’.)

So shooting at the second felon, you are shooting at an individual who is fleeing from *multiple* felonies, both non-violent and violent.

(Personally, I don’t think a judge would buy this argument for a second; but at the same time, I think he would enjoy the logic in it.)

Here in Jersey he’d be in jail for murder and attempted murder. Home defense is a no-no.
