FBI Was ‘Shocked’ to See Judge ‘Waltz’ in and Give Suspect Miranda Rights

Regular viewers of Fox News are used to seeing popular host Megyn Kelly on their televisions every afternoon, but on Thursday morning Kelly made a special appearance during the morning to break some surprising information: according to her sources, the FBI was “shocked” to see a magistrate “waltz into” the hospital room of Dzhokhar Tsarnaev and read him his Miranda rights.

So why were they shocked? According to Kelly, the FBI was under the understanding that they would get much more time with Tsarnaev under the “public safety exemption” before he was read his rights. Adding to the shock: the sources told Kelly agents were getting crucial information after only 16 hours of questioning and were making valuable progress.

No matter.

“It’s really unbelievable,” Kelly said.

“The FBI had no idea they were sending over the judge, the prosecutor, the federal public defender; and the FBI said they were only 16 hours into what they understood would be a 48 hour period of questioning … . They said they were in the process of getting valuable information … and as soon as that magistrate judge went in there and gave him his rights with his lawyer present, he stopped talking. They said they would never have stopped interrogating him prior to the 48 hours unless they were forced to.”

The American Citizen Terrorist SHOULD have been Mirandized. That’s the benefit of being a citizen. The FBI and the current administration probably did NOT want Terrorist #2 to be Mirandized because then they would have all sorts of legal wiggle room to let him off the hook AND would set up a nasty precedent for ANYONE they so deemed a terrorist whether a Christian, a conservative, a so-called homophobe, a member of our military—pick one.

The judge put a stop to the wiggle room, IMO. Right thing to do.

Gee, who would ever think that a foreign usurper (enemy combatant) with a forged birth certificate, stolen SSN, fraudulent selective service card with a communist mentor, a domestic terrorist mentor, radical muslim benefactors and CIA directors, gay benefactors, and a lifelong marination radical anti-Americanism could set things in motion that could shock the FBI.

So much for the hospital being a fortress of security. Whoever it was must have had credentails to get into the room, where did they come from and who signed them?

Perhaps when islamic terrorists cause enough suffering to liberal families, maybe, just maybe, the libtards will begin to wake up to what risk we are facing as a nation.

9/11 happened in the heart of New York City - one of the most liberal places in America.

Are they more awake to the Islamonazi threat because of it? Do New Yorkers really acknowledge the true source of this scourge? Or, are they just as willfully blind and politically correct as they've always been?

Is it legal for a Judge to Mirandize someone? Are they considered police or peace officers? Do they carry a badge, and have to qualify with the standard issue firearms to maintain that status? Personally, I think this Judge acted illegally, but then, I could be wrong.

Is this the same FBI that was assisting in the ‘fierce’ gun-battle with said suspect at the boat? A suspect that later was found NOT to have a weapon? A suspect that was reported to have attempted suicide with said non-existent weapon? The FBI that knew about these brothers since at least 2009? That FBI? What to believe and who to trust.....

I’m not being sarcastic. If the Alharbi who was on the White House visitor list is the same Alharbi who Michelle visited in the hospital, then he - Hamza, the son of Bin Laden - has been visiting the White House and was personally visited in the hospital by Michelle Obama right after his file was changed from “known terrorist” and shortly before he was flown out of the country.

I imagine she had to go through quite a few officers before she even got to the hospital doors...I would think that the very first officer that stopped her car as it approached, called it in to his superior.

Yes, but in those cases someone's attorney filed with a court requesting it. I don't think judges initiate anything until after the proper filings have been made in court.

Nothing tells us who inititated the process that caused those officials to show up at the terrorist's hospital room.

There it is. Everyone knows that. He knew he had the right to keep his mouth shut but was cooperating anyway. The question I want answered is what did the judge and entourage tell him to make him shut up. Them waltzing in there wasn't because the judge had a wild hair to do so. They were there upon someone's orders. I suspect the Miranda was an excuse to relay a message to get hussein's muzzy brother to keep quiet. I also want to know when he was officially arrested. There isn't a hint of indiscretion of him not being read his rights if he wasn't under arrest. Let him tell it all and then arrest and read him his rights.

Is this the same FBI that took 27 days to get to Benghazi to investigate ?
And then they spent a total of 8 (Eight) hours doing their investigation ..
and now look at the result of how that investigation worked out !!

Can a president or governor instruct a judge or magistrate to go and read someone their Miranda rights? What about separatin of powers?

hussein does anything he wants no matter what the law might say.

The so-called 48 hour rule is an FBI/LEO created time limit that has never been sanctioned by the courts or congress. Also, the “public safety exception” to Miranda requires an imminent threat to LEO or public safey based upon objective evidence. The exception is not supposed to be used as a license to conduct an unrestrained interrogation that goes beyond the subject matter of the threat. Don’t shoot the messenger.
