Holder Threatens Kansas Over New Gun Law

Kansas Governor Sam Brownback received a letter today from Attorney General Eric Holder threatening action against the state should it enforce SB102, the pro 2nd Amendment law Brownback signed into law last month.

The new law declares that the federal government has no power to regulate guns manufactured, sold and kept only in Kansas.

Any act, law, treaty, order, rule or regulation of the government of the United States which violates the second amendment to the constitution of the United States is null, void and unenforceable in the state of Kansas.

The legislation made it a felony for a federal agent to enforce any law, regulation, order or treaty regulating ammunition made, sold and kept in the state because the federal government does not “interstate commerce” authority over such items.

Message to those who sat out the last election or voted loonitarian. This would not be happening under Mitt Romney

Voter fraud aside, Romney lost because he is a left-winger only slightly to the right of Obama. Deal with it. It's been almost 6 months. How much longer are you people going to keep whining that your fellow conservatives won't vote for liberals?

They really don’t like that we are a republic of republics. Each state has its own legislature and its own executive. And they have the power to pass and enact laws for their own people. And Holder doesn’t like that.

Holder can send all the letters he wants, but the most he can do is sue the state of Kansas.

Surely no one here thinks Kansas or any other state with such legislation would prevail in today’s court. Even Scalia thinks the interstate commerce clause allows for intrastate commerce to be regulated.

Note to Holder, you have to read the laws beore you can vote on them. Oh, pay attention to the part where laws are not subject to voting if you want to keep them or not.

One would think as the head cop of the Nation he would know that.

Obama vs. The 2nd Amendment

Obama vs.:
Article 1, Section 8 enumerated powers,
The 2nd Amendment,
The 4th Amendment,
The 9th Amendment, and
The 10th Amendment.

Let's see how far the thugs are willing to push this. Kansas isn't South Carolina of 1860, but it's a real state with real Americans. Freedom is popular in Kansas, probably far more popular than Obama.

Part of the problem in the primaries is that leftwing leaning states are voting early; ie. Iowa and New Hamphire. Deep red states, like mine are some of the last to vote. Those states would most likely go for the more conservative candidates.

It is more than about the 2nd. It is about state's rights. If Kansas can say that the Fedgov can enforce gun laws, then it can say the same about EPA rules or OSHA regs.

What is interesting is that the kept things very low key when Montana tried it, but are escalating on Kansas.
