Kansas Secretary of State to Eric Holder: Stay Out of Kansas – You Don’t Understand the Constitution

Kansas signed the Second Amendment Protection Act (SB 102) into law last month.
The bill protects gun owners from from new federal gun control laws and would actually make it illegal to enforce those laws within the state of Kansas.

Eric Holder threatened Kansas last week calling the new state law unconstitutional.

In response Kansas Secretary of State Kris Kobach, fired back.
The general gist of the message was, “You’re wrong. You don’t understand the Constitution. Bring it on.”

Kobach insisted the State of Kansas was determined to restore the Constitution to protect the right of its citizens to keep and bear arms.
So far, Holder has not responded.

Same here. I'm in Florida, but would gladly muster in Kansas to be deputized.

I think this administration has bitten off more than it can chew...and the dominoes are starting to fall. Once Obamacare is fully implemented...we may be in full blown rebellion.

And I want a law like this in Texas.

Bravo for Kansas standing up to the Feds. But I think it won’t work — the Feds will argue that even if the gun was manufactured by a Kansas-resident manufacturer, that gun will contain parts or raw materials manufactured outside of Kansas.

I would be very surprised if the gun manufacturer doesn’t buy at least some raw materials from outside of Kansas.

I would expect a Federal court to rule that therefore, the interstate commerce clause applies.

Kobach graduated from Washburn Rural High School in Topeka, Kansas in 1984. Four years later, he earned an A.B. (summa cum laude) in Government from Harvard University, graduating first in his class in the Government Department. Subsequently, the Court of St. James awarded him a Marshall Scholarship, which allowed him to earn M.A. and D.Phil. degrees in Politics from Oxford University (in 1990 and 1992, respectively). He then returned to the United States and attended the Yale Law School, where he earned his J.D. in 1995.

Not that he’s as smart as Obama or Holder, of course...ironically, he was born in Madison, WI.

Wonderful letter. I was afraid that all politicians lost all of their spine when they attained office.

Kansas will suffer some punishment for this from the vindictive administration.

Any gun purchased in Kansas, made in Kansas, has an effect on interstate commerce because it would have been bought from an out of state manufacturer if it wasn’t bought in Ks.

Not true. If Kansas permits the production of weapons that are otherwise banned by Federal law then they will be uniquely available in Kansas and not anywhere else. This cleverly obviates Wickard v. Filburn.

I want a law like this in Texas.

HB872 now in the House in Texas awaiting committee approval before it goes to the full House for a vote. Allows for manufacture of firearms up to 1.5 inch bore diameter for smokelss powder guns an no limit for black powder, hehehehehe. I always wanted a 37mm cannon!

Careful there. Holder might take over and occupy the administrative offices in the capital kind of like he did with the college admin offices back in the day when he was a “known” radical seeking justice. LOL! He sure ain’t seeking justice these days. Rhetorically, why aren’t these people in jail already where they should be?

Well we have Texas, Arizona, and now Kansas flying in the face of Eric Holder. Texas on the issue of EPA interference with Texas businesses, Arizona on the issue of enforcing valid federal law concerning illegal immigrants, and now Kansas on the issue of the second amendment and interstate commerce.

Not bad! 3 down and 47 states to go.North Carolina may be next on the issue of “NO Obama Care! because they have refused ALL federal money relating to the subject and have opted out of Obie Care as a state.

Eric Holder should have been impeached during his 1st month in office, when he stated that all white citizens of the USA are cowards.
