The Ohio attorney general said on Friday that DNA tests showed Cleveland kidnapping and rape suspect Ariel Castro is the father of the six-year-old born while he allegedly held the girl's mother and two other women captive for nearly a decade.
Attorney General Mike DeWine said in a statement that "forensic scientists worked throughout the night to confirm that Castro is the father of the six-year-old girl born in captivity to one of the kidnapping victims."

The law must presume innocence but we don’t.
Also, because these were kidnap victims, there will be no need to prove or disprove consent. Once they prove the kidnap, there is no defense that any sex was consensual.
There is no such thing as consensual sex with a captive. If they are not free to leave, they are not free to refuse. The proof of the first crime (kidnap) perfects the proof of the subsequent actions as criminal rapes and the kidnap will be an aggravated circumstance heightening the severity of sentencing.
As to the last part of your post, our system of justice is suppose to presume innocence until proven guilty.
Regarding the middle portion of your post, are you serious? Legitimately and consensually conceived? Despite this being in the early stages of investigation, and a trial date to be determined at an unknown future date, how does a man legitimately and consensually conceive a child with a girl he abducted and held hostage for 10 years? He cannot claim consensual sex with a girl who he kidnapped.
Put him immediately in amongst the general prison population.

What I find more interesting is that he was twice arrested for domestic abuse and had been under a restraining order - but he was still hired to be a school bus driver.

Well, I agree they probably won’t have as much a problem proving rape intent as cause of the miscarriages. But the defense could presumably argue that from his perspective the women were in love or theirs was a mutual affair or whatever. More likely is an insanity of plea that of not mentally competent and that he didn’t understand the Miranda rights etc.
However, I have heard that Ohio has some of the strictest laws in the nation for felony murder, when it leads to the termination of a pregnancy. This guy is in for a “bad day”...following the usual rounds of appeals.

Satan has been working overtime lately - Benghazi, Gosnell, Boston, West, foreign factories, Cleveland, and hussein’s latest antics. Every time you turn on the tv these days, something worse has happened.
It gives the prosecution one more charge against him.
There was a report that “RIP” and a woman’s name had been found written on a wall—as if the women held prisoner knew of a fourth woman who had died. Of course it would take more than that to show that she was murdered but the surviving women could be able to testify to the circumstances of her death (assuming the report is right).
The testing was done not only to assure that it was Ariel Castro but to eliminate his brothers from consideration as charges go forward.
