Top IRS official will invoke Fifth Amendment

WASHINGTON – A top IRS official in the division that reviews nonprofit groups will invoke the Fifth Amendment and refuse to answer questions before a House committee investigating the agency’s improper screening of conservative nonprofit groups.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening – or why she didn’t reveal it to Congress, according to a letter from her defense lawyer, William W. Taylor 3rd.

Lerner was scheduled to appear before the House Oversight committee Wednesday.

“She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course,” said a letter by Taylor to committee Chairman Darrell E. Issa, R-Calif. The letter, sent Monday, was obtained Tuesday by the Los Angeles Times.

All the sources that I looked up indicate that a special prosecutor may be appointed by the judiciary or by Congress.

The Ethics in Government Act of 1978 did allow for Congressional and Judiciary involvement but that law had a time limit. It was reauthorized a couple of times but after the Clinton impeachment it was allowed to expire sometime in 1999. I think the Justice Department has a regulation allowing for appointment of a special counsel, such as Patrick Fitzgerald in the Plame matter, but that is up to the Justice Department. If there is any other current authority, I would certainly be interested in knowing about it.

You don’t understand Miller to have quoted it here. To use the 5th means a person cannot be found guilty but there is nothing that says exercising the 5th can’t lead to an investigation.

Obama’s Brother’s non-profit got it’s status in something like 60 days. It was also backdated two years to cover all of the illegal fundraising done during that time under the aegis of being a non-profit previous to application for and approval of his group’s non-profit status.

Huh?

Pleading the 5th means refusing to testify on the grounds that it may be incriminating. No one can be compelled to testify against themselves.

It has nothing to do with immunity from a guilty verdict. I've often thought it's more likely to provoke further investigation than well-counseled testimony, myself.

Yes, in Texas. I just got out of the bathroom as we had rotation on top of my town. Thank God it didn’t go all the way to tornado.

Mo had quit the call girl business when she began dating John Dean, but Mo’s fellow call girls had put her page back into that book to annoy her. Mo complained to Dean, and Dean sent the Plumbers to the Watergate, where they got caught and the rest is history.

We lost one of our little apple trees last night. Red delicious or golden delicious not sure which. We planted it in 2010 and it wasn’t very big around. Wind just bent it over and snapped it almost in two.

We don’t have tornado activity in forcast tonight, just some thunderstorm warnings. The first front slipped south of where they expected it. A second is on it’s way to hit later this morning.

I have been doing some reading on retrofitting homes and businesses for tornado, earthquake, and fallout protection, and just came back to check FR to see what’s going on. Got to get ready for bed soon.

Small town close to me made the news tonight. A long time ago they made these domes for their schools. They look like two giant breasts sticking out of the ground. All kinds of boobie nicknames. Those domes are just about the safest thing there is for tornadoes etc.

You must be pretty damn smart to be able to tell me what I do or don’t understand.

Of course I understand Miller. I have it here on my hard drive, and can post it for you if you haven’t read it lately.

And you are correct that this MIGHT trigger a bigger investigation, but you said “Special Prosecutor”, and that’s not about an investigation, that’s about an indictment.

If a criminal trial was underway, and the defendent (or, in fact anyone associated with the proceedings) took the fifth, it would be an APPEALABLE ERROR if the Judge did not make it clear to the jury that taking the fifth CANNOT be the basis for a presumption of guilt.

It’s not really a criminal act, when there is no serious jail time, and the guy who fixed the election still gets to keep his job.

Winning is all that matters. Afterwards, pardons and shopping for judges are the status quo.

Easy peasy, nice and easy.

After those are done, a college tenure for reward of taking the fall is in order, or a nice cushy job in the fed.
