IRS Could Revoke Non-Profit Status for Religious Institutions over Same-Sex Marriage

Based on Wednesday’s Supreme Court ruling, in which the Court majority determined that the Defense of Marriage Act’s federal definition of marriage had to incorporate state-based same-sex marriages, Internal Revenue Service regulations could be modified to remove non-profit status for churches across the country.

The DOMA decision makes clear that marriage is a state-to-state issue, meaning that religious institutions that receive non-profit status on the federal level but do not perform or accept same-sex marriages in states where it is legal could have non-profit status revoked.

Furthermore, should the IRS move to revoke federal non-profit status for churches, synagogues and mosques that do not perform same-sex marriage more generally, the Court could easily justify that decision on the basis of “eradicating discrimination” in religious education.

The Court stated in Romer v. Evans (1996) that states could not take measures to prevent future distinction of gays and lesbians as a protected class under state law; in Lawrence v. Texas (2003) the Court ruled that same-sex sexual activity was Constitutionally protected; in the DOMA case on Wednesday, the Court ruled that DOMA was unconstitutional not merely on federalism grounds, but because it violated the equal protection clause of the 14th amendment and the due process clause of the Fifth Amendment.

On the state level, a movement is already under way to revoke non-profit status for religious organizations that do not abide by the same-sex marriage. In Massachusetts in 2006, Boston Catholic Charities withdrew from adoption services thanks to the state mandate on same-sex adoptions, rather than fight the issue in court. In California, a bill is already making its way through the legislature to bar non-profit status for any religious youth group that discriminates on the basis of “gender identity, race, sexual orientation, nationality, religion, or religious affiliation.”

This is actually fine with me.

I have often wondered how these propaganda machines which perpetuate myths and amass millions and billions of dollars, including priceless real estate and artworks could possibly enjoy tax-exempt status.

Call me what you will, but that's the way I look at it.

There was a Legal Wonk from our side on Bill Bennett that warned of this can of worms and the lawsuits against halls of faith who refuse.

This is the destruction of our Judeo-Christian Nation.

Exactly.

I've noticed an odd sense of detachment among many Christians in this country over "gay marriage," and I finally figured out what is driving it.

Most committed Christians see marriage as a religious institution and simply don't give a flaming sh!t about what any government thinks about it.

Another argument FOR the FairTax!

FairTax does not distinguish between not-for-profit and for-profit organizations: Under FairTax, NO business organizations pay federal taxes. They, if they sell a product at retail, merely collect the FairTax and send it to the collection agency. If they are not in a retail business, there is no taxable activity; ergo, churches are tax-FRee with respect to the collection plate.

These SCOTUS rulings may actually be of some benefit to us!

If there was ANY doubt that the goal is to wipe out Christianity in America, this Ruling was the icing on the cake.

Sex deviates DO NOT BELONG IN ANY CHURCH, and now that Muslims and Sharia Law are going to be next to take front row seats in America, EVERY Christian church should give up their Tax Exempt Status, and stick to their Principles.

We don't need faggots/dykes in our churches, as they have chosen to violate God's and Nature's Laws.

Not such a bad thing. Those churches would no longer be havens of the 'wealth preachers', would be biblical in that they would then render unto Caesar and would then be free to criticize those who rule over us.
