Exclusive: IRS manual detailed DEA's use of hidden intel evidence

Reuters) - Details of a U.S. Drug Enforcement Administration program that feeds tips to federal agents and then instructs them to alter the investigative trail were published in a manual used by agents of the Internal Revenue Service for two years.

The practice of recreating the investigative trail, highly criticized by former prosecutors and defence lawyers after Reuters reported it this week, is now under review by the Justice Department. Two high-profile Republicans have also raised questions about the procedure.

A 350-word entry in the Internal Revenue Manual instructed agents of the U.S. tax agency to omit any reference to tips supplied by the DEA's Special Operations Division, especially from affidavits, court proceedings or investigative files. The entry was published and posted online in 2005 and 2006, and was removed in early 2007. The IRS is among two dozen arms of the government working with the Special Operations Division, including the Federal Bureau of Investigation, the National Security Agency and the Central Intelligence Agency.

An IRS spokesman had no comment on the entry or on why it was removed from the manual. Reuters recovered the previous editions from the archives of the Westlaw legal database, which is owned by Thomson Reuters Corp, the parent of this news agency.

This is the same way we would reverse-engineer computer chips. There would be a “clean-room” where they were figuring out how certain things worked. However there was another operation on the other side of town where they were popping the tops off of the things and providing “clues” on what to try next in the not really “clean-room”.

We “just happened” to figure out a number of complex bus clocking structures used in certain proprietary computer systems in the early 90’s in this way.

Levin explained what they are doing (begun by the GWB admininstration BTW) and expanded with “This One” using rules of evidence on his Aug 7th show..

Example; A tip becomes a “routine traffic stop”.Which is a source consealment and reported that device is in general use by the current DOJ not just the DEA.
Note my use of the term “This One”or “That One” which I encourage.

Cases will now gave to be dismissed all over America. This is part of the drug legalization campaign. What’s the next best thing to de jute legalization? De facto legalization where nobody can get convicted Something this patently unconstitutional and contemptuous of the judiciary and our due process rights cannot be accidental.

Let me make sure I'm following your line of thought. Your saying that government agencies across the country have been intentionally lying and falsifying the evidence trail in thousands ( tens of thousands? millions?) of cases as part of a scheme to legalize drugs?

A less polite phrase for this reconstruction is evidence fabrication.

As long as we have the “fruit of the poisoned tree” doctrine in law, which excludes illegally gotten evidence, this practice is itself illegal. The exclusionary rules are becoming increasingly necessary to limit government over-reach.
