Obama EPA Chief Supports Sidestepping Congress on Climate Change

BOULDER—Congress may be unwilling to pass climate-change legislation, but EPA chief Gina McCarthy said Wednesday that’s not going to stop the Obama administration.

In a speech at the University of Colorado Boulder, McCarthy said the administration intends to bypass Congress and use President Obama’s executive authority to advance its climate-change agenda. She cited the president’s June 25 address at Georgetown University, where he unveiled his Climate Action Plan, calling it “a most remarkable speech by a president of the United States.”

“Essentially, he said that it is time to act,” McCarthy said. “And he said he wasn’t going to wait for Congress, but that he had administrative authorities and that it was time to start utilizing those more effectively and in a more concerted way.”

The comments came at the start of a panel discussion on the President’s Climate Action Plan featuring former Colorado Gov. Bill Ritter, Colorado Oil and Gas Association president Tisha Schuller, and Brad Udall, director of the Getches-Wilkinson Center for Natural Resources at the University of Colorado School of Law.

The Obama administration has come under criticism for its aggressive use of executive orders on issues ranging from immigration to welfare to education reform. Republicans have accused the White House of governing by executive fiat, saying it limits the power of the legislative branch and, by extension, voters.

McCarthy received cheers from Ritter, who now heads the Center for the New Energy Economy at Colorado State University. He said he met with the president in March as part of a group to brainstorm on ways to skirt Congress in developing climate-change policy.

We have three branches of government that are at least theoretically coequal and restrained by the constitution and bill of rights.

Then we have the regulatory agencies which are a law unto themselves. There is no bill of rights to protect you from them. The other three branches have set it up this way and are complicit in keeping it this way. It gives them a way around the constitution and gives them complete deniability.

If congress passes a law you have all kinds of noise surrounding it. You can take it to court, you can vote out the people who passed it if you don’t like it. If an agency writes a regulation, it has the force of law and there is no recourse. Take it to court? Sure, fine. They have lawyers too and an unlimited budget for litigation.

As long as the Republicans do nothing why shouldn’t Obama do this?

Heck, the Republicans in the senate rewarded Obama after he declared them in recess.

I want to be angry at Obama but I’m more angry at Republicans who do nothing while Obama legislates.

Nobody is policing our Government. We have a two party system that is
supposed to police each other, we're also supposed to have a media who
does the same thing. But when the both entities fall into formation and become
complicit in covering
up the worst violations such as unconstitutional laws and mandates we're screwed

We are the informed because we seek out this information, but take into consideration
the 80% of America who does not and we have a very dangerous situation that cannot be resolved even by the voters.

Also the labels of conspiracy and racist, etc etc are helping their destruction
of the Constitution. We've become a Vogue nation of Ignorant lemmings.

That has already happened. In 2007 SCOTUS ruled that CO2 was a pollutant, that EPA should determine the threat of CO2 and if needed regulate with the Clean Air Act.

First Bush, then Obama deferred to Congress to step up, but Congress couldn't.

Now, we are in the 2nd wave of court action. Were EPA's endangerment findings accurate and does EPA have the authority to "tailor the regulation"? The DC court of Appeals said yes, and now SCOTUS will have to rule on those questions.
