A father has been arrested after beating a naked prowler he found peering into his daughter's window

An Albuquerque, New Mexico dad who found a naked prowler peering into his young daughter's room will face charges after seriously beating the peeping tom.

Police say Emilio Chavez III found 29-year-old Dylan Maho naked and making noises near a little girl's window when he chose to exact vigilante justice and beat Maho so badly he was taken to the hospital.

While both men could be convicted of felonies, Chavez could potentially get a longer sentence for what he did to the intruder.

'There's a naked man outside his daughter's window,' Chavez's neighbor Bill Morang told KOAT. 'I think he was well within his rights chasing him down and beating him.'

But the district attorney disagrees. Though police initially let the irate father go free after questioning, he is now charged with aggrevated battery, a felony.

While both men could be convicted of felonies, Chavez could potentially get a longer sentence for what he did to the intruder.

He'll never be convicted as long as there is one parent on the jury. Any decent attorney should be able to get this reduced to a misdemeanor with probation only.

Serves the guy right. You NEVER beat a man for peering into your daughter’s window, while he’s naked. You shoot him. In the head. The naked dead body and its proximity is all the cops need to let you off.

Trayvon Martin used his fists. George Zimmerman used a gun. Which is waling free and which is six feet under? There is a lesson there.

What the heck happened to New Mexico, specifically Albuquerque in the last 20 years or so? This wouldn’t have even made the middle pages of the papers awhile back, and certainly wouldn’t have been prosecuted.

Are they infested with eastern libs? Or is this home-grown?

The message is CLEAR. If you are a victim - just suffer until the All-Father state comes along to dispense justice.

That DA should be tarred and feathered and run out of town on a rail - and - in a more SANE era of our history WOULD have been.

DA’s....what is wrong with the justice system? No jury is going to convict this guy. I imagine the charges will get dropped at some point or he’ll plea down to a lesser misdemeanor and get probation. “no more beating up naked perverts um-kay?”

Dad's going to get the Zimmerman treatment: "We know we won't get a conviction, but in the process we will bankrupt you and ruin your life unless you accept our plea deal".

I suspect the issue is the race of the prowler, and the DA wanting to avoid trouble from Holder.

For the price of a shovel, this father could have avoided all this trouble. An hour or so of digging in the dark and the problem is,,,, buried, so to speak.

By taking action against citizens like this, prosecutors are raising the possibility that citizens will just practice the 3 S’s and just work outside the law

And there it is, in a nutshell.

I've had a number of people tell me that - God forbid - if someone breaks into your house and you ever need to defend yourself or your family.... make sure to put an extra one into the perp. Especially if he is, say, of a darker hue than you. That way, there aren't two conflicting stories to be told.

Sad state that Liberals have put America in, where good men are forced to escalate, rather than get put into the system which should be defending them.
