PA:Sheriff David May Have Illegally Denied Gun Permits To Hundreds Of People Who Applied

Sheriff George David has illegally denied concealed carry permits to hundreds of people who applied for them, according to some of the state’s top experts on the subject.

An investigation by the Beaver Countian has uncovered over 300 instances in the past two years where individuals who appear to qualify for gun permits under state law, were then denied the right to carry a concealed firearm because of additional policies created by Sheriff David.

Sheriff David requires individuals who are cleared to have a gun permit by the Pennsylvania Instant Check System (PICS is a system run by the Pennsylvania State Police) also be searched in the Pennsylvania Justice Network (JNET) database. David’s policy is to automatically deny gun permits to any individual who JNET shows has been convicted of any crime, even if that crime is not violent, was committed decades ago, and even if the offense is not a disqualifying one under Pennsylvania state law.

The Sheriff spells out this policy succinctly on the county’s official website, writing in bold lettering: “The application must have NO CRIMINAL CONVICTIONS.”

Individuals who have been found guilty of any criminal offense are then required by David to seek an expungement of their conviction through the courts before he will even consider granting a gun permit. If they are unable to get an expungement, or are unwilling to pay the necessary fees to obtain one, they are denied the right to carry a concealed firearm.

The Beaver Countian spoke to several individuals who were denied concealed carry permits because they entered into the Accelerated Rehabilitative Disposition (ARD) program for a single DUI charge, and others who were denied because they were convicted of a minor ungraded misdemeanor years ago.

So far we have but two replies in this thread indicating not a lack of interest among FReepers over the Second Amendment but a tacit understanding that some amendments in the Bill of Rights are more equal than others and some interest groups are of more worth than others.

Suppose the headline which I have doctored above were accurate and the sheriff were denying African-Americans an identification card required for voting because somewhere in their distant past there was a questionable allegation of crime?

I will let the reader supply his own answer to that rhetorical question.

Ahh Beaver County. A world unto itself. Nothing “wrong” with the county per se, just a little “off”...Doesn’t surprise me in the least that lawful processes are being mucked with..

Alleghany county is a lot easier. Fill out a form, pay some cash and wait.
I went down to renew my CCW after I got the card and it took like 20 minutes. The people were cool as well. Heres a tip. After you get your new permit tell them to have a good day and they are shocked because they never have people say that to them.
But then I wish everyone a good day.

Pennsylvania sadly has a long history of corrupt public officials - judges sending kids to prison so that their cronies in the prison can profit from it, judges inventing fake crimes and pocketing the fines, sheriffs like the one in the article ignoring the law, and many more.

And that's not even considering the more typical corruption and incompetence present in city and state government in places like Harrisburg PA.

That doesn't make any sense. ARD is NOT a conviction. It is, legally, a deferment of action on a criminal charge until the rehab is completed. Then the charges are dropped.
