New Mexico Supreme Court: Same-sex marriage legal

SANTA FE, N.M. (AP) — New Mexico's highest court has legalized same-sex marriage, declaring it is unconstitutional to deny a marriage license to gay and lesbian couples.

The state Supreme Court issued its ruling Thursday. New Mexico joins 16 states and the District of Columbia in allowing gay marriage.

Eight of the state's 33 counties have started issuing marriage licenses to same-sex couples since August, when a county clerk in southern New Mexico independently decided to allow the unions.

HA, I see you just had to stick Roberts in there just because you are mad about Obamacare.

Except Roberts didnt join Kennedy on the gay cases, he stuck with Scalia and Thomas on those. Gay issues are not Obamacare issues.

Kennedy has been making up new gay rights for a long time, he helped rule to make same-sex sodomy a constitutional right under GWB era.

The New Mexico Supreme Court “justices” are an example of the failure of out public educational system. The fact is, there WAS no discrimination! The same rules applied to EVERYONE!

Roberts got his first cousin, a lesbian who has “married” her girlfriend to the DOMA hearings. The cousin said before the hearing that she was certain that Roberts would rule in “her” favor. She was disappointed that the Supreme Court didn’t completely throw DOMA out the door. She said afterwords that she was certain that when the case of homosexual “marriage” comes before the court that her cousin (Roberts) will make the family proud and say no one can be denied the right to marry someone. The rumors about Roberts have been around for years.

He voted against the two gay rights rulings. That is a fact.

The fact that his gay relative was disappointed that he ruled against her, as you pointed out, that only makes your claims look more silly.

“Unconstitutional.” The word hasn’t had any actual meaning since FDR took over. Actually, unconstitutional actions have been taking place FROM DAY ONE, ONWARDS! If, only, there was a way to keep track of all unconstitutional actions, by everybody, 100%!

It appears that NM has experienced what PA did in the 80’s.

The great exodus of Leftists from Noo Yawk and Joisey crossed the Delaware like illegals crossing the Rio Grande. They brought demands for their Socialist lifestyles, along with higher taxes and Leftist laws.

As a result, PA went Left and never looked back.

Claiming that "same-gender couples are as capable of responsible procreation as are opposite-gender couples," the N.M. Supreme Court ...

This judge now has to redefine 17 words in the dictionary:

Webster`s definitions of marriage and procreate show that "procreate" is between a father and a mother, not a male and another male or between 2 females:

These “judges” are not critical thinkers. There is NOTHING discriminatory about hetero-sexual marriage being the only one allowed. The same laws apply to BOTH straights and gays. Two straight men can’t marry, any more than two gay ones can. Any man, straight or gay, can marry any woman he can talk into it. The SAME rules apply to all. And the same for females.

NM has always been majority Democratic but there was a mixture of conservative Democrats and "progressive" Democrats. Now most are of the latter type. And I think a disproportionate number of eastern libs (living on Daddy's or family trust funds) and western libs (California and Hollywood types) moved into Artsy-Fartsy Santa Fe. I suspect many of the western libs brought their gay lifestyle with them.

this is the wrong forum for vote counting.

We know Kennedy is the 5th vote. Don’t try to figure it out. Some things on FreeRepublic simply do not make sense arithmetically.

i aint read the whole article yet .. but what is missing is the process for NM voters to amend their constitution ... the only way to deal with this decision.

I know it won’t get thru the legislature ... but the pro-gay reps can be voted out.

It seems certain that the decision will be final. Perhaps some of the state legislators can be voted out now ... but unlikely much of an effort will be undertaken to do that. The backlash will be minimal.

“The Democratic-controlled Legislature repeatedly has turned down proposals for domestic partnerships for same-sex couples and a constitutional amendment that would have allowed voters to decide whether to legalize gay marriage. Measures to ban same-sex marriage also have failed.

Sen. William Sharer, a Farmington Republican who opposes gay marriage, has said a constitutional amendment will be needed to resolve the issue regardless of the outcome of the court case.

The Flora Vista-based Voices for Family Values said its members already are gathering signatures for petitions to present to lawmakers during the upcoming session in January.”

I wasn't vote counting. I know the above.

I was just saying that just because we don't like Roberts decision on Obamacare mandate doesn't mean we should claim that he ruled for gay marriage as pro-gay Kennedy did, when we know he didnt.

Thats a completely different point.

What I find the MOST frustrating on this gay marriage issue is how Republicans *argue* against it, if they do.

It usually goes like :

“I just believe that marriage is ...”

or “Many people believe that homosexuality is ...”

And they use the term homosexuality which implies a state of being like race. That is surrendering under the guise of debating. They call 'sexuality' 'orientation'.

They no longer use the term ‘homosexual behavior’ to distinguish between people and actions. If people's 'sexuality' is really part of their being, like race or sex, then there is no real case against it.
That means the the fight is over and they just mouth the words to appease us.

To engage in sodomy is a choice. No one is born a sodomite. Lord, how many women have I known in my life that are shacking up with another woman, that was married to a man for years and had 5 or 6 children by him. All the sudden at age of 45 they realize they’re “lesbian”. Yea, they were really “born” that way. Nothing they can do about it. And I believe in the tooth fairy.

Republicans are not opposed to “gay marriage”. Conservatives are.

The leadership of the NY GOP helped push it thru.
The majority of rank ‘n file Republican voters opposed it.

same in CT.

Of course, no organized effort exists to stop the “Gay Marriage” movement. Not the GOP. Not the churches. lip service, yes. There were isolated instances in NY where GOP gay marriage Senators were primaried and defeated. Isolated.

In Iowa, there was an organized backlash. Nationally, there is no backlash. Accomodation and surrender.
